An Act Respecting
Fair Fuel Pricing

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Fair Fuel Pricing Act.

2 In this Act,

(a) "regulations" means the Petroleum Products Pricing Regulations made under Section 14 of the Petroleum Products Pricing Act;

(b) "wholesale margin" has the same meaning as in subsection 17(3) of the regulations.

3 Within six months of the coming into force of this Act, the Governor in Council shall amend the regulations by

(a) repealing clause 17(1)(f) and Section 17A; and

(b) adding provisions to clarify that costs incurred in compliance with the Clean Fuel Regulations (Canada) made under sections 140 and 326 and subsection 330(2) of the Canadian Environmental Protection Act, 1999 and subsection 5(1) of the Environmental Violations Administrative Monetary Penalties Act (Canada) cannot be recovered in wholesale margins or other customer costs.
