Whereas this program would not be possible without the sponsorship of PanCanadian Energy, the Nova Scotia Teachers Union and the federal Department of Veterans Affairs' Postcards for Peace initiative;

Whereas women also made an invaluable contribution to the war effort at home, running the family farm, raising families and working in the factories, producing the armaments and aircraft used by our armies abroad;
Therefore be it resolved that on Remembrance Day the members of this House praise the incredible and often unsung contributions of the women veterans and all those women who kept home and industry afloat during the great conflicts of this century.

Whereas Mr. Jamie Peppard of Middleton, Nova Scotia won 1st place at the All-Strength Canadian Finals on August 18th at the Canadian Exhibition Grounds in Toronto with an overall score of 43.5; and
Whereas the All-Strength Canadian finals required excellence in a variety of events, including a caber toss, a weight-lifting challenge and a truck pull involving a 41,000 pound Mack tractor and trailer; and
Whereas at 6'1" and 275 pounds Mr. Peppard has been training and competing for 10 years, and most recently won second place in the 2001 Atlantic Canada's Strongest Man competition;
Therefore be it resolved that the members of this House congratulate Mr. Jamie Peppard for winning first place at the All-Strength Canadian Finals and for illustrating the importance of physical fitness and good personal health through his many years of dedicated training and competition.

Whereas the annual tournament was chosen the top event in Nova Scotia for 2001 at the Tourism Industry Association of Nova Scotia gala awards, thus making it familiar to other parts of Nova Scotia;

Whereas the people of Nova Scotia remember all too well the Minister of Health's and the Premier's promise to fix the health care system for $46 million; and
Whereas for $300 million, the people of Nova Scotia have experienced reduced health care services, fewer specialists, longer waiting times, fewer nurses and higher Seniors' Pharmacare premiums;
Therefore be it resolved that this Minister of Health apologize to the people of Nova Scotia for single-handedly dismantling the health care system.

Whereas the Quinpool Road merchants, this past February, formed the Quinpool Road Mainstreet District Association which, among other things, publishes a monthly newsletter to inform local businesses of the new initiatives;
Therefore be it resolved that this House commend the retailers of the Quinpool Road Mainstreet District Association for their monthly newsletter and for initiating plans to conduct cooperative marketing projects and physical improvements within the Quinpool Road community.

Whereas urban waterfronts are dynamic, unique places which help define their cities and The Waterfront Centre, a non-profit urban planning organization, focuses on the best long-term uses of waterfront resources and recognizes outstanding waterfront projects through their annual Excellence on the Waterfront Awards; and
Whereas the Historic and Maritime Preservation/Adaptive Reuse Award for the year 2000 has been awarded to the Waterfront Development Corporation Limited, and its private partners, Lydon Lynch Architects, Environmental Design Management and O'Halloran Campbell Engineering; and
Whereas they have been recognized for their vision and their enhancement of metro's waterfront through the combination of three projects: Halifax Waterfront Rejuvenation, Halifax Harbourwalk and Open Space and Development Plan;

Whereas the Cornwallis Museum Society recently applied to the Historic Board of Canada to have the former CFB Cornwallis Base designated as being of national historic significance; and
Whereas as a vital training base, particularly in World War II, the site truly deserves this historic designation as it has been stated that the training at CFB Cornwallis must receive some credit for the Allied victory in the Battle of the Atlantic; and
Whereas the former base merits this honour both as a national historic site and for the role it played in training so many generations of Canadian men and women;
Therefore be it resolved that this House encourage and support the society in its efforts so that present and future generations may have the tangible reminder of the role the base played in adding to the national fabric of Canada.

Whereas vehicles would leave the lineup facing a red traffic light, causing chaos when they meet oncoming traffic with no efforts made to apprehend those drivers;
Therefore be it resolved that this House urge the Minister of Transportation and Public Works to make a greater effort to stop the dangerous practice by installing cameras, or other means of stopping this dangerous practice during the next phase.

Bill No. 83 - Maritime Provinces Harness Racing Commission Act.
MR. SPEAKER: The honourable Minister of Agriculture and Fisheries.
HON. ERNEST FAGE: Mr. Speaker, I am pleased to move for second reading, an Act to Amend Chapter 8 of the Acts of 1993. The Maritime Provinces Harness Racing Commission Act. Overall, what this amendment does is eliminate the role of marketing and promotion of harness racing and increase the Maritime Harness Racing Commission's focus on the regulatory part of the industry. It states that the role of the commission will be to govern, regulate and supervise harness racing and all of its forms relevant and related to parimutuel betting.
It also clarifies the role of the commission in recruiting, training, evaluating, licensing, racing judges and other officials. The commission is responsible for establishing uniform rules for the conduct of harness racing, Maritime Provinces-wide, as well, Mr. Speaker. Also, it requires the commission's annual report to include recommendations with respect to the governance and regulation of the harness racing industry and removing the power of the commission to promote and encourage the breeding and racing of horses.
There are a number of other small housekeeping items that the Governor in Council may deal with and that is it may appoint any minister to be responsible for the Harness Racing Commission, thus removing the specific reference to Agriculture and Fisheries, and a number of definition clarifications. But the real thrust of this piece of amended legislation is to focus the Maritime Harness Racing Commission on the regulations and governance of the harness racing industry and remove promotion from the harness racing Act here so that it will be purely a regulatory function.
MR. SPEAKER: The honourable member for Hants East.
MR. JOHN MACDONELL: Mr. Speaker, certainly, I have to say that I would agree with what the minister has said regarding the bill. I think the most significant part of the bill is that the commission is getting out of the promotion business. We can say that probably, in effect, the government is getting out of the promotion business as well, but actually maintaining a regulatory role there. I think everyone would deem this appropriate. I think it certainly raises eyebrows when the same organization is in control of regulation and promotion both. I think that these are two hats that a single body should not wear and I would say that to allow the commission a regulatory and governance would be appropriate and the promotion part should not be there. I think for the best interests of all concerned in the industry this is the most appropriate step.
As the minister said, there are some definition changes here. We are to speak to specific parts of the bill, but I think most of the guts of the bill are in Clause 3(b) which, "restricts the power of the Commission with respect to race tracks from governing, regulating, directing, controlling and supervising the operation of race tracks to directing and controlling the operation of race tracks;", Clause 3(c) which, "removes from the Commission the power to promote . . .", and Clause 3(d) which, "expands the powers of the Commission with respect to harness-racing judges and other officials who attend at harness-racing meets on behalf of the Commission from employing such officials to also include recruiting, training, evaluating and licensing such officials . . .".
I think these would be deemed as appropriate by the public and would ensure credibility of the industry and we would be supportive of this legislation moving forward.

MR. DONALD DOWNE: Mr. Speaker, I am pleased to rise again. I guess we have been pretty well holding the fort down here on issues relative to agriculture. When Bill No. 83 came in, I thought of only one person to check the bill out with. As I understand the railbird on this side of the House that is the resident expert on the harness racing industry in Nova Scotia is my good friend and my colleague to my right, the member from Sydney.
He has had many years of experience in the horse racing industry and owned a few and maybe won a little bit, maybe lost a little bit (Interruptions) But I can tell you one thing, that every single race this member has been in for political purposes, he has always won. So the bet should always be for him to win, on the nose, as they would say.
AN HON. MEMBER: Nine straight wins.
MR. DOWNE: Nine straight wins. Now getting back to the bill. (Interruptions)
ANOTHER HON. MEMBER: They weren't maiden races. (Laughter)
MR. DOWNE: There is another railbird who just moved to the front benches of the New Democratic Party too. I understand that he understands the business very well.
I rise in my place today to make a few comments on Bill No. 83, an Act to Amend the Maritime Provinces Harness Racing Commission Act.
Mr. Speaker, it is a bit of déjà vu in some ways all over again with this government. As you know, there are a lot of good and well-intentioned individuals in the harness racing industry, people who have spent their lifetimes building the pedigrees and building the industry from the ground up. They have done a lot to attempt to re-establish the industry in somewhat turbulent economic times. I want to congratulate those individuals for the work they have done.
Mr. Speaker, the government has been making some choices and priorities as to where its dollars should go. Recently we heard about some of the initiatives that are important to the Province of Nova Scotia. I do find, recently, that the government has made a choice. One of its priorities is a $1 million grant to the harness racing industry. The government is about making choices, and it made that choice last week. I certainly hope that the government thought long and hard with regard to those specific choices as it developed the $17 million list of cuts in other government spending throughout Nova Scotia. I also understood that that $1 million that went in - if I am correct on that, I think it went in - was going to be going in after a study was completed to show the viability of the industry, which we all hope will be viable. I remember all too well when I was minister, we put money in to look at the viability of the industry.
Today we see the bill before us that says they support the industry. I would hope that study could be brought forward, that I could have access to that information that would be appropriate for our files. We also see that the bill is reassigning roles and responsibilities, which is a good idea. Reassigning these roles and responsibilities as they pertain to the marketing of harness racing means that the regulatory role of the Maritime Provinces Harness Racing Commission will be strengthened, and I believe that's a good move. I don't know;
maybe there's a member in the Premier's office that has a good understanding of this, but I think this is a good idea. We will be supporting the principle of that.
Reassigning the marketing and promotion roles will give someone else the sole responsibility of trying to make the industry, an industry that is valuable to the economy of rural Nova Scotia, work. For that we give our support. One has to ask who that someone else will be. We hope that someone else will be someone, a body or a group of bodies, that will be good, solid individuals and not just political plants, but really there for the best interest of the industry. I believe this industry is at a very serious crossroads. We need the very best people, whoever they might be. If they are all Conservatives but they are all the best people, that's fine with me, as long as they're the best people making the decisions regarding the viability of the harness racing industry. Splitting the roles will ensure that all parties can focus on their respective responsibilities, which is key and which will, hopefully, increase the likelihood of the industry succeeding.
I would like to end my remarks here by quoting the Minister of Agriculture and Fisheries, on October 30th, when he stated the following: The $1 million grant is available to the harness racing industry next year, if they can convince government it can get back on its feet. I hope they can convince government. I hope they have good, solid business plans to show that. We are also hopeful that we, in turn, will have the opportunity to see the logic and the convincing words that were used to make it happen. Perhaps this legislation is a last attempt to enable the harness racing industry to get back on its feet. We all hope, I am sure all members of this House hope, that the industry can be viable, can be sustainable, can be predictable and can have a long-term viability in the Province of Nova Scotia because it affects rural Nova Scotia and it affects a lot of people.
I look forward to hearing the comments made to the public Law Amendments Committee and the future deliberations. With those few comments, we move that it goes forward.

I certainly appreciate the comments of both of my colleagues opposite. They too, same as government members, realize that the harness racing industry has a long and proud history in this province and a viable business opportunity into the future is desired, certainly, by all members.

As well, I appreciate their comments and acknowledge that the intent is to separate the promotion and the regulation of the industry and leave the Maritime Harness Racing Commission a strengthened regulatory body rather than a divided promotional and regulatory agency. Bill No. 84 - Vital Statistics Act.
MR. SPEAKER: The honourable Minister of Service Nova Scotia and Municipal Relations.
HON. ANGUS MACISAAC: Mr. Speaker, I move that this bill be now read a second time. The bill would amend the existing Vital Statistics Act to increase protection around the issuance of birth certificates in Nova Scotia. These changes would restrict issuance of birth certificates to certain individuals and increase penalties in place for their fraudulent use.
Currently, Nova Scotia's procedure to apply for a birth certificate is in step with, or ahead of, other jurisdictions within Canada and the U.S. The proposed amendments are preventative as opposed to being reactive. We continuously seek areas of improvement by consulting with stakeholders such as passport and immigration officials, law enforcement agencies and other levels of government.
Law enforcement officials tell us that ID fraud is on the rise, here at home and around the world. A complete ID package of a birth certificate, social insurance number and a passport can sell for $25,000 or more on the black market. A simple birth certificate itself can be valued at $10,000.
In light of recent terrorist activities, security for identity documents has become a national issue. There is an increased level of concern from politicians, security officials, government agencies and members of the public with respect to issuance of basic personal identification documents such as birth certificates.
Service Nova Scotia and Municipal Relations issues about 40,000 birth certificates each year. We want to make sure that our security practices and procedures are balanced with the need to provide service to members of the public who have a lawful and necessary requirement for these documents. Our challenge is to try to prevent identity theft without imposing burdensome red tape for the thousands of people who legitimately request a birth certificate each year.
In order to increase levels of security for the issuance of vital statistics documents, action is required to implement thoughtful and tangible improvements. Nova Scotia has an opportuntiy to take a leadership role in this process by combining immediate, proactive action on two fronts, legislative and procedural.
Legislative changes would further define individuals who can obtain a birth certificate. For example, if you wanted a copy of your birth certificate, you could obtain it yourself or the parents of an individual could obtain the birth certificate. In the event of death, the estate trustee could also obtain such a document.
As a means of security, our current practices and our continuing practices require me to provide detailed information about my parents, including their names, if I were to get a certificate, my mother's maiden name, their places of birth, a civic address and a daytime telephone number. In the event that the wrong information is supplied, Vital Statistics personnel would dig deeper and ask more questions to determine whether or not fraudulent activity is taking place.
On the legislative front, we include increased penalties for engaging in fraudulent activities. The current fine is just $200. This would be increased to $50,000 or two years imprisonment. These fine increases would give law enforcement officials added clout in bringing to justice people engaged in this type of criminal activity. I should point out also that this is a maximum fine with no minimum.
Procedural improvements involve how our staff processes information for certificates. Proposed changes would include historic cross-referencing of birth and death certificates. This serves as a check against someone attempting to assume the identity of a dead individual. We are promoting improvements to enter jurisdictional data sharing through the National Vital Event Data Capture and Routing System. This system would provide jurisdictions across Canada and the U.S. with immediate information to update birth records
of individuals who die in another jurisdiction; information critical to the security and issuance of birth certificates.
Mr. Speaker, on the procedural front, would also involve educating the public about the protection of their certificates once in hand. A birth certificate is a legal document. It is printed on security paper. It is proof of identity. With it you can get a social insurance number, a driver's license, a passport. It needs to be kept in a safe place, not in a wallet.
Mr. Speaker, the Vital Statistics Council for Canada has established a security committee to review the practices of Vital Statistics Registries across Canada. Within the next few months, this committee will be proposing recommended national standards for the issuance of birth certificates. Today's proposed amendments are the initial steps to forging a higher level of security and confidence in our vital statistics records. The research of the national committee, combined with our own stakeholder consultation, will provide a foundation for any further changes required for the protection of Nova Scotia birth certificates. We intend to continue to keep our vigilance and examine our processes. We want to make sure Nova Scotia remains a safe, secure and preferred place in which to live and work.

MR. SPEAKER: The honourable member for Halifax Fairview.
MR. GRAHAM STEELE: Mr. Speaker, I am pleased to rise this morning as the Official Opposition Critic for Service Nova Scotia and Municipal Relations and, therefore, for the Vital Statistics Act. Let me be the first to say that identity fraud and identity theft is a real issue around the world. There have been, for example, clear indications that identity theft and fraud were implicated in the events of September 11th. There have been some regrettable events in the past where Canadian passports, in particular, have been misused and abused by those performing illegal acts or attempting to do so. So it is important that we maintain the integrity of the official identity documents that we have, like the Canadian passports and like our birth certificate.
Having said that though, Mr. Speaker, this bill raises a number of questions, and I'm hoping over the course of debate, or before it passes through the House, that the minister will be able to answer. The first one is whether we do in fact have a problem in Nova Scotia. The minister is bringing forward a solution, but what's the nature of the problem in Nova Scotia? Are there documented cases of there being identity theft or identity fraud here in Nova Scotia? If so, how many? If so, what evidence do we have of how they were perpetrated and how they might be prevented? Once again, I say the minister is bringing forward a solution, but what we don't know, because there's no information on the table, is whether this solution
actually will fix the problem that we have in Nova Scotia if, indeed, we have a problem in Nova Scotia.
Another question that comes up, Mr. Speaker, that I hope the minister will be able to answer - I'm sure there is a good answer to this question, I'm just hoping he will be able to provide it - is why this bill is being tabled before the National Security Committee comes forward with its recommendations. Why is Nova Scotia passing legislation before the National Security Committee has the opportunity to study the problem and make recommendations? Doesn't it make more sense to do it afterwards, or is there a preliminary report where the members of the committee, in fact, jurisdictions across Canada agree on these as preliminary steps? What we are facing, of course, is the possibility that after the National Security Committee issues its recommendations that this will be found to be not enough or the wrong thing to do. I am just curious about why it is that the legislation is coming forward in advance of the report of this National Security Committee.
At any rate, Mr. Speaker, those are questions. There may well be good answers to them and I look forward to the minister being able to provide those answers over the course of the debate. Thank you.
MR. SPEAKER: The honourable member for Cape Breton The Lakes.
MR. BRIAN BOUDREAU: Mr. Speaker, I rise in my place just for a few moments to speak on the principle of Bill No. 84. This particular bill, of course, is being brought forward so as it can make more of a difference in eliminating the opportunity to commit identity fraud using a birth certificate.
Mr. Speaker, during times of uncertainty in our world, and certainly as a result of September 11th, legislation like Bill No. 84 is even more important. To improve and strengthen legislation and the procedures in the system in obtaining a false birth certificate is a positive step.
Our caucus looks forward to hearing from the public and all interested parties as to whether the minister has created a piece of legislation that will do the job and not create a lot of bureaucratic red tape. There is no question that the security and the safety of Nova Scotians is paramount in all our minds. Because birth certificates are used by law enforcement agencies, immigration and passport officials, strengthening the process to obtain a certificate will improve the ability of these agencies to do even a better job than they do today.
There is one area of concern that does surface in regard to this whole legislation, and it is in regard to the fee structure. It is the fee that will be associated with obtaining a birth certificate that concerns all of us. I certainly hope that the minister does not plan to use these
new, enhanced security features as an excuse to jack up the fees on obtaining a birth certificate for Nova Scotians; the safety and the security of Nova Scotians is far too important to be used as a revenue generator. I also hope that the minister plans to proclaim this legislation as quickly as possible; again, it is paramount that we protect the safety of Nova Scotians.
I want to thank the minister for tabling this bill and I do look forward to hearing what the public has to say during the Law Amendments Committee process, but in closing, Mr. Speaker, I think it is important to recognize that this is an initiative by the federal government. It is a direction from the federal government as a result of meetings that the minister had with his counterparts and the federal minister, and the government is not getting ahead of the other provinces in this regard.
Finally, I want to congratulate and thank the staff of Vital Statistics for having the ability to move in such a manner as to have this bill presented here today. Thank you.
MR. SPEAKER: The honourable member for Cape Breton West.
MR. RUSSELL MACKINNON: Mr. Speaker, I hadn't contemplated on making any observations because I believe my colleague, the member for Cape Breton The Lakes, has pretty well covered some of the key issues, but there are a number of additional issues that I think perhaps the minister may want to give some further explanation on, and that is with regard to a lot of cases in Nova Scotia where individuals don't have exact details on their place of birth - and I will explain that in a little bit more detail - as well as securing some documentation on the exact place of birth and some additional details in terms of the wording of their parents and so on.
Many of the individuals I sometimes have to deal with are individuals who are immigrants from other countries. Over a period of time, for various reasons, whether it be for assimilation or what have you, they felt it more appropriate to change the spelling of their last names. I can't recall any particular circumstance right off hand, because some of the names would be rather complicated to even pronounce, let alone spell. I found that in trying to ascertain that information in sufficient detail to be able to secure a birth certificate for them to be able to get, for example, their social security, their Canada Pension or what have you, that became a considerable problem.

I would ask, perhaps, if maybe the minister might be able to outline in some detail how that process might be further streamlined or simplified so as to allow these individuals, not that there are that many, I am sure, across Nova Scotia, because the department has kept considerably good records. Sometimes these individuals are forced to go back and find their
baptismal certificate or some piece of documentation that would show the year they started school or what have you. As hard as it may seem for ourselves to believe that a person wouldn't know whether they were born in 1901 or 1902, that is the circumstance for some of them because accurate records were not maintained. As their parents brought them from another country and they settled here in Canada and subsequently in Nova Scotia or directly to Nova Scotia, they were left in a rather precarious position.
I wanted to raise that with the minister, because sometimes a Commissioner of Oaths, such as an MLA or someone who has the official designation by an OIC, is forced to sometimes go on some hearsay evidence to be able to determine the exact detail as required for a birth certificate. That's a considerable issue, still, for a lot of people who have immigrated to Canada. I think what the minister is saying, in the general context of things, because of some of the issues that surrounded September 11th, this is an excellent opportunity to close the gap on a lot of . . .

MR. SPEAKER: Actually the Chair did notice the young lady come in. I actually thought it was the honourable member's daughter. (Laughter) We welcome you here today, and we hope you enjoy the proceedings. I would like you to note the honourable member is quite quiet since you've come in. (Laughter)

MR. MACKINNON: Mr. Speaker, I am not going to engage in any debate on those matters. I would presume that because of some of the events from September 11th that the minister and the government saw it wise to move, perhaps, a little more expeditiously on this matter, particularly in the event - it's been shown that some terrorists around the country and particularly in the United States have been going around with their suitcases, their briefcases with at least a half dozen different birth certificates and IDs and passports. (Interruptions) Well, because it has been reported on through the media. We don't always agree with everything the media says, but certainly I would suspect security agencies wouldn't report such items through the media unless it was true.
Mr. Speaker, the other issue, too, is being cognizant of the fact that we're not going
to stereotype. I think that has been another concern that has been raised, that when individuals would try to secure their vital statistics information, because they might be of a certain heritage they may be stereotyped. I am not sure if that will factor into this particular legislation or not. I would hope it doesn't. I don't suspect that it does. It doesn't look like it does.
Of course, one other item is the one that my colleague, the member for Cape Breton The Lakes, has raised and that is the issue of fees. It seems to be quite a mindset within government lately not to raise taxes, but to implement more user fees. What is a little bit disturbing about that is the fact that the Assistant Deputy Minister from the Department of Health, before the Public Accounts Committee earlier this week, couldn't even give us a definition of what a user fee was. She couldn't tell us what the user fee definition was. She really didn't know. She indicated that she didn't have any clear definition. I would hope that there is not that type of variance from one department to the other that we can't ascertain, in some substantive way, the difference between a user fee and a hidden tax.
So with that, Mr. Speaker, I think, on measure, it is a good piece of legislation. The issue of the fine structure, certainly, as has been raised earlier, is the question of how much data is out there to show that people have actually been violating the opportunity to access vital statistics, particularly on the issue of birth certificates. So with that, I will wait for the minister's closing remarks. Thank you.

HON. ANGUS MACISAAC: Mr. Speaker, I thank honourable members opposite for their contribution to the debate. Within the department, there has always been a level of vigilance with respect to the fraudulent use of birth certificates or documents related to vital statistics. That process was ongoing, and there was a considerable amount of work that they
have wanted to do and partly process but also legislative in terms of increasing the level of security around these documents.
Obviously, Mr. Speaker, the events of September 11th have brought a greater focus to the need for an increased level of security around these documents and the legislation attempts to do that. But in addition, the legislation is not unlike the motto of the Boy Scouts, which is Be Prepared. What this legislation does is enable us to be prepared to respond to initiatives that are taking place on a national scale. The honourable member wanted to bring credit to his Party by suggesting it is an initiative of the federal government. If that makes him feel good, then that is fine with me. The important thing for us is that the work get done and the job get done. We are, in fact, working very closely with national bodies right across the country. There have been conference calls with other ministers responsible for vital statistics within the country. We all recognize the need to be prepared to move on a national basis to ensure that the level of security is what it should be within this country.
This legislation will enable us to respond to those urgencies as they come forward, to be able to respond and put in place the level of security that is needed surrounding these documents and to ensure that it is consistent across the country so that Canadians can feel that their security relative to documents such as passports, because the birth certificate is the entry to the passport, does exist. So the legislation is very much legislation designed to ensure that we are prepared to respond to these opportunities to increase the level of security. There is no intention in this legislation of doing anything with respect to fees, it is not about fees at all in any way, shape or form. It is about increasing the level of security.
Mr. Speaker, I thank the honourable member who made reference to the frustration sometimes of getting documents. On one hand, I have shared that experience, I remember one day saying to somebody, well, can you at least give him a certificate of existence, you know that level of frustration. On the other hand, the very fact that we are dealing with the issue of security suggests that those steps have to be in place to ensure that we in fact are safeguarding security. I share your concern. I am not sure what the solution is. If you feel you have one, I would love to hear it. Having said that, I want to thank the honourable members for their participation in the debate and look forward to the bill proceeding through the other stages. Thank you.

Bill No. 85 - Real Estate Trading Act.
MR. SPEAKER: The honourable Minister of Service Nova Scotia and Municipal Relations.
HON. ANGUS MACISAAC: Mr. Speaker, I move that this bill be now read a second time.
The proposed amendments are fairly straightforward. The Real Estate Trading Act goes back to 1997 and the Real Estate Commission derives its authority from the Real Estate Trading Act which was passed in 1996. Since that time it has become apparent that some housekeeping work needs to be done with respect to the legislation and this is an attempt to deal with those issues. The original legislation was lacking in a few respects and we want to correct those deficiencies. Most of the changes that we are dealing with today were proposed by the commission and they were reviewed by the department and we have found them to be reasonable changes and we are quite pleased to bring them forward in response to the commission's request.
Several of the amendments help clarify the status, roles and responsibilities of the commission and its commissioners. First of all, it declares that the commission is a body corporate which had not been declared in the previous legislation. I understand that the legal minds would probably understand it better than I, but by creating a body corporate it does assist in providing some protection to the members of the commission and its employees. The legislation further attempts to provide that protection from personal liability of commissioners, committee members, registrar and the minister for actions taken in good faith in administering the Act.
It also requires that information about licensees and applicants be kept confidential except in certain specific circumstances. It also allows the commission to set standards for agency relationships in its bylaws. The consumer protection and enforcement capabilities of the commission will be enhanced by these amendments. Clause 8 allows the commission to apply directly to the Supreme Court for an injunction to stop someone who is violating the Act, such as selling real estate without a licence. Today the commission must go through other authorities such as police to obtain an injunction. With this change the commission will be able to go directly to the court and seek an injunction. Other organizations such as those regulating doctors, architects and engineers already have this authority.
Two other amendments clarify areas of confusion. The process of disposing of unclaimed trust funds is expanded upon. After two years the commission can take these over from individual brokerages and administer them for another four years after which if still not
claimed they may be used for a public or charitable purpose. Reference to a manager's licence is removed from the Act because the commission has changed its categories of licences in its bylaws and the manager's licence name is no longer being used.
To improve public accountability, Cabinet is being given authority to make regulations concerning the contents of the annual report of the commission to the minister. Mr. Speaker, these amendments support the effective operation of the commission. They will not diminish any existing protections for buyers or sellers involved in real estate transactions. In fact, these protections will be enhanced.

MR. GRAHAM STEELE: Mr. Speaker, I'm pleased to rise again this morning as the Official Opposition Critic for Service Nova Scotia and Municipal Relations and, therefore, also for the Real Estate Trading Act. The Real Estate Trading Act is another in a fairly large number that deal with professional regulation and discipline. As the minister mentioned, there is the Barristers Act, there is one dealing with engineers, architects and so on. Really there must be at least 15 and possibly 20 such Acts in Nova Scotia and they're important because these professional regulatory bodies represent a branch of government, really a quasi-government, that are very important to the professionals.
Just as importantly, Mr. Speaker, in addition to raising professional standards, they're there for the protection of the public because the Real Estate Commission has the power to issue licences to real estate traders and brokers and no one who does not hold such a licence can trade in real estate in Nova Scotia. So there's a very strong element in these pieces of legislation for the protection of the public and the maintenance of professional standards.
From time to time it happens that gaps become apparent, that holes in the legislation become evident from particular case situations, either in Nova Scotia or across Canada and this bill seems to be very much in keeping with that tradition. It appears that some deficiencies have been identified and, on the recommendation of the commission and with the support of the government, these amendments are being brought forward to the House. I have reviewed the provisions in detail. They seem to be quite reasonable, quite acceptable. I see nothing that causes any concern here. I wish the Real Estate Commission all the best as it continues the work of maintaining and improving professional standards in Nova Scotia and protecting the public interests in the trading of real estate. The government can look forward to the support of the Official Opposition on this particular bill.

MR. BRIAN BOUDREAU: Mr. Speaker, I am also pleased to rise again in my place to make a few comments on the principle of Bill No. 85, the Real Estate Trading Act. It is important, I believe, to take note that these changes were made under the recommendation of the Nova Scotia Real Estate Commission. I thank them for their active role in bringing this legislation forward and, obviously, convincing the minister that these changes are necessary.
As is the case of many organizations, the Real Estate Commission, as a result of the changes to this Act, will be recognized as a corporate entity. This is important as it will limit the personal liability of the directors on the commission, as well as the volunteers. This will enable them to carry out their duties without the threat of legal action. The ability of the commission to apply directly to the Supreme Court of Nova Scotia to stop someone who may be conducting unlicensed trading, will speed up the process. This Act will be very important for the Real Estate Commission, Mr. Speaker, because it will enable the commission to gain greater enforcement powers for dealing with unlicensed real estate sellers.
I thank the minister for putting in the legislation at the request of the Real Estate Commission and I look forward to hearing public input during the Law Amendments Committee process. Thank you.

Whereas this year Shelburne County's Roseway River 4-H Club, a small 30-member club, took projects to the 4-H provincial show and had an outstanding showing in a variety of competitions and claimed the 4-H provincial flag for the second year in a row;
