An Act Respecting the Remuneration
of Educational Assistants and Substitute Teachers

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Educational Assistants and Substitute Teachers Remuneration Act.

2 The purpose of this Act is to ensure that the remuneration of educational assistants and substitute teachers in the Province is on par with the highest levels of remuneration for those positions in the Maritime provinces.

3 In this Act,

"Maritime provinces" means the Provinces of New Brunswick, Nova Scotia and Prince Edward Island;

"Minister" means the Minister of Education and Early Childhood Development.

4 (1) The Minister shall study the comparative levels of remuneration for educational assistants and substitute teachers in the Maritime provinces.

(2) Within six months of the coming into force of this Act, the Minister shall publish a report outlining the findings of the study referred to in subsection (1).

(3) Subject to Section 6 and within one year of publishing the report referred to in subsection (2), the Minister shall, in coordination with the Minister of Finance and Treasury Board, implement remuneration increases for educational assistants and substitute teachers in the Province to achieve the purpose of this Act.

5 (1) The Governor in Council may make regulations

(a) prescribing calculation methods and minimum thresholds for remuneration increases under subsection 4(3);

(b) defining any term used but not defined in this Act.

(2) The exercise by the Governor in Council of the authority in subsection (1) is a regulation within the meaning of the Regulations Act.

6 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
