Clause 1 adds definitions for "Family Pharmacare Program" and "Seniors' Pharmacare Program".

Clause 2 requires the Minister to provide full coverage for the Recombinant Zoster Vaccine (Shingrix) for the prevention of the herpes zoster virus (shingles) for persons who are enrolled in the Seniors' Pharmacare Program or the Family Pharmacare Program.

An Act to Amend Chapter 7
of the Acts of 2011,
the Fair Drug Pricing Act,
Respecting Pharmacare Programs

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 7 of the Acts of 2011, the Fair Drug Pricing Act, is amended by

(a) adding immediately after clause (k) the following clause:

    (ka) "Family Pharmacare Program" means the Family Pharmacare Program established by the Minister under Section 3;

and

(b) adding immediately after clause (t) the following clause:

    (ta) "Seniors' Pharmacare Program" means the Seniors' Pharmacare Program established by the Minister under Section 3;

2 Chapter 7 is further amended by adding immediately after Section 11 the following Section:

    11A (1) Notwithstanding subsection 10(1), the Recombinant Zoster Vaccine (Shingrix) for the prevention of the herpes zoster virus is deemed to be designated as a benefit under that subsection.

    (2) Notwithstanding subsections 11(1) and (2) but subject to subsection (4), the Minister shall provide full coverage of the cost of the Recombinant Zoster Vaccine in the benefit list established under Section 11 for persons enrolled in the Seniors' Pharmacare Program or the Family Pharmacare Program.

    (3) Subject to subsection (4), no copayment or deductible may be charged in connection with the Recombinant Zoster Vaccine for persons enrolled in the Seniors' Pharmacare Program or the Family Pharmacare Program.

    (4) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
