Explanatory Notes

Clause 1 updates the definition of "Minister".

Clause 2 requires a regulating body to submit statistical data and other information to the Review Officer upon the Review Officer's request.

Clause 3

(a) clarifies and updates the information which regulating bodies must provide in their reports to the Review Officer;

(b) changes the reporting schedule so as to require regulating bodies to submit reports to the Review Officer every five years instead of every two years; and

(c) requires regulating bodies to demonstrate compliance within one year of the Review Officer making a finding of non-compliance.

An Act to Amend Chapter 38
of the Acts of 2008,
the Fair Registration Practices Act

Be it enacted by the Governor and Assembly as follows:

1 Clause 2(c) of Chapter 38 of the Acts of 2008, the Fair Registration Practices Act, as amended by Chapter 14 of the Acts of 2014, is further amended by striking out "Labour and Advanced Education" in the first and second lines and substituting "Labour, Skills and Immigration".

2 Section 15 of Chapter 38, as amended by Chapter 14 of the Acts of 2014, is further amended by adding immediately after subsection (3) the following subsections:

    (4) Upon a request by the Review Officer, a regulating body shall submit statistical data and other internal review and registration decision information which the Review Officer may include in the annual report under subsection (1).

    (5) The data and information that the Review Officer may request under subsection (4) includes

    (a) application statistics;

    (b) registration statistics;

    (c) internal review statistics;

    (d) information on timelines for processing registration decisions;

    (e) information on timelines for processing internal reviews; and

    (f) any other information the Review Officer deems necessary for completion of the annual report under subsection (1).

3 (1) Subsection 16(3) of Chapter 38 is amended by

(a) striking out clause (b) and substituting the following clause:

    (b) the criteria used to assess whether the requirements for registration have been met;

(b) striking out clauses (e) and (f);

(c) striking out "practices" in the first line of clause (h) and substituting "policies";

(d) adding "to reach a registration decision" immediately after "take" in the last line of clause (l); and

(e) striking out clause (o).

(2) Subsection 16(8) of Chapter 38 is amended by striking out "two" in the first line and substituting "five".

(3) Section 16 of Chapter 38 is further amended by adding immediately after subsection (11) the following subsection:

    (12) Where the Review Officer, based on an assessment of the information provided in a report required under subsection (2), makes a finding that the registration practices of the regulating body are non-compliant with this Act or the regulations, the regulating body shall demonstrate compliance in the manner prescribed by the Review Officer within one year of the finding of non-compliance, unless the Review Officer extends the one-year deadline.
