Explanatory Notes

Clause 1 amends the Real Estate Appraisers Act so that the Act does not apply to a person appraising real estate pursuant to an election by a surviving spouse under the Intestate Succession Act.

Clauses 2 to 6 amend the Election by Widow Regulations to use gender-neutral language and to indicate who may conduct appraisals.

An Act to Amend Chapter 25
of the Acts of 1998,
the Real Estate Appraisers Act,
and the Election by Widow Regulations

Be it enacted by the Governor and Assembly as follows:

1 Subsection 2(2) of Chapter 25 of the Acts of 1998, the Real Estate Appraisers Act, as amended by Chapter 30 of the Acts of 2015, is further amended by adding immediately after clause (c) the following clause:

(ca) a person appraising real estate pursuant to an election by a surviving spouse under the Intestate Succession Act;

2 The title of N.S. Reg. 75/77, the Election by Widow Regulations, made pursuant to Section 6 of the Intestate Succession Act, is amended by striking out "Widow" and substituting "Surviving Spouse".

3 N.S. Reg. 75/77 is further amended by striking out "widow" wherever it appears and substituting "surviving spouse".

4 N.S. Reg. 75/77 is further amended by adding immediately after Section 3 the following Section:

3A (1) An appraisal required under Section 3 may be done by any person familiar with the appraisal of the real estate or the household goods and furnishings being appraised.

(2) For greater certainty, persons referred to in respect of real estate in subsection (1) are not limited to persons registered pursuant to the Real Estate Appraisers Act.

5 Section 4 of N.S. Reg. 75/77 is amended by striking out "his" in the first line and substituting "the".

6 Form A of N.S. Reg. 75/77 is amended by striking out "(widower)" in the seventh line.
