Explanatory Note

This Bill amends the Correctional Services Act and the Police Act to require the development and implementation of uniform training programs and guidelines for correctional services employees and police officers who work with individuals with mental disabilities.

An Act to Amend Chapter 37
of the Acts of 2005,
the Correctional Services Act, and
Chapter 31 of the Acts of 2004,
the Police Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 37 of the Acts of 2005, the Correctional Services Act, is amended by adding immediately after Section 6 the following Section:

6A (1) Subject to subsection (2), the Minister shall develop and implement uniform training programs and guidelines for employees who work with individuals with mental disabilities.

(2) The moneys required for the purpose of this Section shall be paid out of moneys appropriated for that purpose by the Legislature.

2 (1) Section 5 of Chapter 31 of the Acts of 2004, the Police Act, is amended by adding immediately after subsection (1) the following subsections:

(1A) Subject to subsection (1B), the Minister shall develop and implement uniform training programs and guidelines for police officers who work with individuals with mental disabilities.

(1B) The moneys required for the purpose of subsection (1A) shall be paid out of moneys appropriated for that purpose by the Legislature.

(2) Subsection 5(3) of Chapter 31 is amended by adding ", (1A)" immediately after "(1)" in the first line.
