Explanatory Notes

Clause 1 adds regulation-making powers to the Liquor Control Act

(a) prescribing a code of conduct with respect to the acceptance of gifts from liquor suppliers by members of the Board of Directors of the Nova Scotia Liquor Corporation and employees of the Corporation or the Government of Nova Scotia or their spouses; and

(b) defining a word or expression used but not defined in the Act.

Subclause 2(1) removes the prohibition against members of the Board of Directors, employees of the Corporation or their spouses having any involvement with a business or undertaking that deals in the sale of liquor.

Subclause 2(2) provides for a code of conduct to govern the giving of gifts to members of the Board of Directors, employees of the Corporation or the Government or their spouses by persons selling liquor to the Corporation or the Government.

Clause 3 provides that this Act comes into force upon proclamation.

An Act to Amend Chapter 260
of the Revised Statutes, 1989,
the Liquor Control Act

Be it enacted by the Governor and Assembly as follows:

1 Section 50 of Chapter 260 of the Revised Statutes, 1989, the Liquor Control Act, as amended by Chapter 28 of the Acts of 2000, is further amended by adding immediately after clause (i) the following clauses:

(ia) prescribing a code of conduct for members of the Board of Directors, employees of the Corporation, employees of the Government or spouses of such members or employees for the purpose of subsection (4) of Section 81;

(ib) defining any word or expression used but not defined in this Act;

2 (1) Subsection 81(1) of Chapter 260 is repealed.

(2) Section 81 of Chapter 260 is further amended by adding immediately after subsection (3) the following subsection:

(4) Notwithstanding subsections (2) and (3),

(a) a member of the Board of Directors, an employee of the Corporation or employee of the Government or a spouse of a member or employee may receive a gift from a person having sold, selling or offering liquor for sale to the Government or the Corporation; and

(b) a person selling or offering for sale to, or purchasing liquor from, the Government or the Corporation may directly or indirectly offer to make a gift to a member of the Board of Directors, an employee of the Corporation, employee of the Government or a spouse of the member or employee, or to anyone on behalf of such member, employee or spouse,

only if the gift would be acceptable pursuant to Guidelines 1. to 4. of the Ministerial Code of Conduct set out in Schedule B to the Members and Public Employees Disclosure Act or a more restrictive code of conduct prescribed by regulations under this Act.

3 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
