An Act to Authorize the
Municipality of the County of Antigonish
and the Town of Antigonish to Make
Grants to St. Francis Xavier University

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the St. Francis Xavier University Millennium Centre Grants Act.

2 In this Act,

(a) "grant" means a grant authorized by this Act;

(b) "Municipality" means the Municipality of the County of Antigonish;

(c) "Town" means the Town of Antigonish;

(d) "University" means the Governors of St. Francis Xavier University, Antigonish, Nova Scotia, a body corporate.

3 (1) Notwithstanding any other enactment, the Municipality and the Town may each grant to the University up to five hundred thousand dollars to be used by the University to construct and maintain a new Millennium Centre.

(2) A grant shall be paid

(a) over such number of years, not exceeding ten;

(b) in instalments of such amount and frequency; and

(c) with interest at such a rate, not exceeding seven per cent per annum, where the grant is made by the Municipality and not exceeding eight per cent per annum, where grant is made by the Town,

as the Council of the Municipality, by resolution, determines, where the grant is made by the Municipality or as the Council of the Town, by resolution, determines, where the grant is made by the Town.

4 (1) All sums required by the Municipality to make a grant shall be held to be sums required for the ordinary lawful purposes of the Municipality and may be raised, levied and collected in the same manner and in all respects as other money required for the ordinary lawful purposes of the Municipality is raised, levied and collected.

(2) All sums required by the Town to make a grant shall be held to be sums required for the ordinary lawful purposes of the Town and may be raised, levied and collected in the same manner and in all respects as other money required for the ordinary lawful purposes of the Town is raised, levied and collected.

5 Notwithstanding any other enactment, the Municipality and the Town may each borrow any amount up to five hundred thousand dollars to make a grant.
