Explanatory Note

This Bill amends the Protecting Access to Health Services Act to expand the definition of

(a) "health care facility" to include the residence of a health service provider; and

(b) "health service provider" to include persons responsible for executive decision-making respecting health services.

An Act to Amend Chapter 24
of the Acts of 2021,
the Protecting Access to Health Services Act

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of Chapter 24 of the Acts of 2021, the Protecting Access to Health Services Act, is amended by

(a) striking out clause (c) and substituting the following clause:

    (c) "health care facility" means

      (i) a place where health services are being performed, delivered or received,

      (ii) the residence of a health service provider, and

      (iii) a place designated as a health care facility by the regulations;

    (b) striking out "or" at the end of subclause (d)(i);

    (c) striking out the semicolon at the end of subclause (d)(ii) and substituting ", or"; and

    (d) adding immediately after subclause (d)(ii) the following subclause:

      (iii) is responsible for executive decision-making respecting health services;

2 Subsection 6(1) of Chapter 24 is amended by

(a) adding "or" at the end of subclause (d)(i); and

(b) striking out subclause (d)(ii).
