Explanatory Note

This Bill permits the traffic authority to prohibit the use of a diesel engine enhanced braking system while operating a vehicle on a highway for which the speed limit is more than fifty kilometres per hour.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act,
to Enable the Further Restriction
of the Use of Diesel Engine
Enhanced Braking Systems

Be it enacted by the Governor and Assembly as follows:

1 Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding immediately after Section 181A the following Section:

181B (1) A traffic authority may prohibit the use of a diesel engine enhanced braking system while operating a vehicle on a highway designated by the traffic authority for which the speed limit is more than fifty kilometres per hour.

(2) No person shall use a diesel engine enhanced braking system while operating a vehicle on a highway where the use of that system has been prohibited pursuant to subsection (1).

(3) Subsection (2) does not apply to fire department or other emergency vehicles.
