Explanatory Note

This Bill requires all school facilities to be made available to non-profit groups at cost.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act,
to Require All School Facilities
to be Made Available
to Non-profit Groups at Cost

Be it enacted by the Governor and Assembly as follows:

1 Section 64 of Chapter 1 of the Acts of 1995-96, the Education Act, as amended by Chapter 5 of the Acts of 2002, is further amended by adding immediately after subsection (4) the following subsections:

(5) A school board shall make all of its facilities available on the basis of recovering the incremental cost to non-profit community groups for meetings and other activities that are compatible with the school environment and that do not interfere with the delivery of school programs.

(6) Any lease or other agreement with a school board in place on the coming into force of this subsection that requires fees to be paid for the use of school facilities that are in excess of the amount required to recover the incremental cost is deemed to be amended to comply with subsection (5) and any dispute concerning the amount of the incremental cost shall be determined by the school board.
