Explanatory Note

This Bill requires a Class II environmental assessment to be held before an underground mine is approved under the Environment Act.

An Act to Amend Chapter 1
of the Acts of 1994-95,
the Environment Act

Be it enacted by the Governor and Assembly as follows:

1 Section 34 of Chapter 1 of the Acts of 1994-95, the Environment Act, is amended by adding immediately after subsection (1) the following subsection:

(1A) Notwithstanding subsection (1), where an undertaking registered pursuant to Section 33 involves the development of an underground mine, the undertaking shall not be approved until a Class II environmental assessment as defined in the regulations has been held and, for greater certainty, Sections 36 to 41 apply to the assessment.
