Clause 1 provides that a chief officer of a municipal police force must meet minimum qualifications as set out in the regulations and be selected after an open competition.

Clause 2 provides for the composition of a board of police commissioners and the term of office of the members of the board.

Clause 3 requires a municipal board of police commissioners to

(a) submit to the municipal council for approval a code of ethics for the members of the board; and

(b) prepare an annual report and submit it to the municipal council and the Attorney General.

Clause 4 sets out a procedure for dealing with complaints against a municipal board of police commissioners or a member of the board.

An Act to Amend Chapter 348
of the Revised Statutes, 1989,
the Police Act

Be it enacted by the Governor and Assembly as follows:

1 Section 14 of Chapter 348 of the Revised Statutes, 1989, the Police Act, is amended by adding immediately after subsection (1) the following subsections:

(1A) Before appointing a chief officer pursuant to subsection (1), the council of the municipality shall hold an open competition for the position of chief officer of the municipal police force.

(1B) The public shall be given notice of the competition referred to in subsection (1A) and notice of the competition shall be posted for a reasonable period of time.

(1C) The chief officer appointed pursuant to this Section must have the qualifications set out in the regulations.

2 Subsection 19(2) of Chapter 348 is repealed and the following subsections substituted:

(2) A board consists of three persons appointed by the council and three persons appointed by the Attorney General.

(2A) The persons appointed pursuant to subsection (2) hold office for a term not to exceed two years.

3 Chapter 348 is further amended by adding immediately after Section 20 the following Section:

20A (1) A board shall submit to the council for approval a code of ethics for the members of the board.

(2) A board shall prepare an annual report covering the activities of the board for the preceding year and submit the report to the council and the Attorney General.

4 Chapter 348 is further amended by adding immediately after Section 27 the following Section:

27A (1) A complaint respecting a board or the conduct or performance of a member of a board shall be referred to the Commission in accordance with the regulations.

(2) The Commission shall investigate the matter and attempt to resolve the complaint.

(3) Sections 26 and 27 apply mutatis mutandis to a complaint referred to in subsection (1).
