Explanatory Note

This Bill sets out the method of proving the name, age and residence address of an applicant for a driver's licence.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 71(2) of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is repealed and the following subsections substituted:

(2) An applicant for a driver's license or any photo identification issued by the Department shall prove, to the satisfaction of the Department, the applicant's name, age and residence address by the presentation of original documents issued by a recognized public authority that confirms the information provided by the applicant.

(2A) An applicant for a driver's license or photo identification document who cannot produce original documents proving the applicant's name, age and residence address to the satisfaction of the Department may provide to the Department sworn affidavits of two persons who have personal knowledge of the applicant and the Department may, at its discretion, accept the affidavits as satisfactory proof of the applicant's name, age and residence address.

(2B) Notwithstanding subsections (2) and (2A), where an applicant presents a valid driver's license from another jurisdiction recognized by the Department that indicates the applicant's name, age and residence address, the Department may issue to the applicant a driver's license or photo identification document if the Department is satisfied that all other requirements for the issuance of the driver's license or identification have been met.
