Explanatory Note
This Bill requires advances against construction projects to be held in trust for tradespeople.
An Act to Amend Chapter 277
of the Revised Statutes, 1989,
the Mechanics' Lien Act
Be it enacted by the Governor and Assembly as follows:
1 Chapter 277 of the Revised Statutes, 1989, the Mechanics' Lien Act, is amended by adding immediately after Section 6 the following Section:
6A All sums advanced under a mortgage to an owner, the proceeds of which are to be used for the purposes of financing work or services or the provision of materials related to real property, are deemed to be held in trust for every person entitled to a lien on the property under Section 6 by reason of supplying the work, service or materials.
