Whereas today is the start of the lobster fishing season for southwestern Nova Scotia; and

Whereas the hard work of our fishermen is the reason our province can offer and boast the best supply of cold-water lobster in the world to the world; and

Whereas while we all worry about the effect of the strong dollar in resource industries like the lobster fishery and will work with our fellow provinces and the federal government on possible solutions, the most important concern each day is the safe return of the fishermen and their boats;

Therefore be it resolved that all members of this House offer our best wishes to the lobster fishermen of southwestern Nova Scotia on "dump day" and our hopes that during the season they haul in good catches and remain safe.

Whereas Operation Red Nose offers those celebrating the holiday season a free ride home and ensures their car gets home too; and

Whereas this year the successful campaign will extend beyond its traditional metro base to now include Truro;

Therefore be it resolved that all members of this House salute the efforts of the IBC and its team of hundreds of volunteers whose efforts have undoubtedly saved lives and educates Nova Scotians about the dangers of drinking and driving.

HON. BARRY BARNET: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the global theme for the 2007 World AIDS Day is leadership, with the ongoing campaign slogan of "Stop AIDS. Keep the Promise" and the pandemic hit record levels in 2006 with 4.3 million people becoming infected with HIV - more than any previous year; and

Whereas 8,000 people die of HIV/AIDS worldwide every day, representing 25 million lives already lost to date around the world, and there are new HIV infections in

Canada every two hours with a total of 60,000 people living in Canada with HIV infections, including AIDS; and

Whereas in Nova Scotia and Prince Edward Island, 713 people have tested positive with HIV between 1985 and 2006, and there is a red ribbon display symbolizing the 8,000 daily deaths on Citadel Hill during this week;

Therefore be it resolved that all this Province of Nova Scotia join governments and people from around the world in a single effort to raise awareness about HIV and to express global solidarity in the face of the pandemic. The province does hereby proclaim the week of November 24th to December 1st to be Canadian HIV/AIDS Awareness Week and December 1, 2007 to be World AIDS Day in the Province of Nova Scotia, and the province encourages all its citizens to work together to strengthen HIV awareness and prevention and to support all those living with, or affected by, HIV/AIDS.

Whereas National Child Day was on November 20th and celebrated this year's theme, The Right to be Active, encouraging physical activity among children; and

Whereas this theme reflects Canada's commitments under the United Nations Convention of the Rights of the Child, which recognizes children's right to be happy and enjoy the highest attainable standard of health; and

Whereas the Department of Community Services is encouraging physical activity and healthy child development through a new $4.9 million Outdoor Play Space Grant for licenced child care centres as part of our 10-year Early Learning and Child Care Plan;

Therefore be it resolved that all members of this House recognize the importance of informing parents, caregivers and educators that physical activity is essential to the health and well-being of Nova Scotian children, which corresponds to the health and well-being of the future of this province.

Whereas Fred Walsh, a retired employee from the Department of Agriculture, has been appointed as a member of the Order of Canada in recognition of his lifetime of volunteer service; and

Whereas Mr. Walsh has been very involved with the CNIB since losing an eye in a farming accident, and active with the church, Salvation Army, and many other charitable organizations over the years; and

Whereas in recent years, Mr. Walsh has been providing informal counselling and encouragement to many in the farming community, especially some of the struggling sectors;

Therefore be it resolved that members of this Legislature congratulate Mr. Walsh for his selfless work over the years and offer him best wishes on his continued and enjoyable retirement.

Whereas the Nova Scotia Department of Natural Resources presents the Nova Scotia Woodlot Owner of the Year Award each year to recognize and reward landowners for outstanding stewardship of their woodland and to help encourage the practice of sustainable woodlot management; and

Whereas this year Kevin and Susan Veinotte of Northfield, Lunenburg County, were chosen as provincial winners from among three regional finalists; and

Whereas Kevin and Susan are not only excellent woodlot managers, but also the first in Eastern Canada to be certified organic Christmas tree growers;

Therefore be it resolved that all members of this House acknowledge the outstanding achievement of Kevin and Susan Veinotte, and thank them for their enthusiastic and innovative approaches to woodlot management in Nova Scotia.

Whereas Mr. Marshall who was born in Trenton, Pictou County, and graduated from the Nova Scotia Agricultural College, Macdonald College and the University of Guelph, worked for 26 years with the Department of Agriculture, and also served on the board of Scotian Gold Co-operative Limited and the Nova Scotia Fruit Growers Association;

Whereas every Spring for the last 11 years Shirley and David Whiston of Halifax have started their annual camping season by collecting information and maps from tourist centres and by compiling lists of church suppers, fairs, plays, concerts, museum displays, and other special events occurring in Nova Scotia; and

Whereas Shirley and David Whiston do this because they are valued and dedicated members of the Nova Scotia Department of Natural Resources' Campground Host Program; and

Whereas all campground hosts help visitors to this province and other campers by offering information about the facilities and programs in the park, the surrounding community and in all of Nova Scotia;

Therefore be it resolved that all members of this House show their appreciation for the 10 years of volunteer service by the Whistons and for all the campground hosts like them who are great ambassadors of this beautiful province.

Whereas as a result of Mr. Smith's actions, I am pleased to be working with the Summerville Fire Department and Chief Ron Spencer in submitting the necessary information to the Office of Governor General Michaëlle Jean to nominate Mr. Smith for a Canadian Medal of Bravery;

Whereas a volunteer committee organized a huge fundraiser which raised the money for the purchase of this van; and

Whereas this committee received donations from the President's Choice Children's Charity through the Liverpool Market Superstore, Q104 Children's Trust Fund, Bowater's Employees Safety Points, Bowater's Pipefitters, Milton Centennial School, David Hatt Jr. of Hatt's Car Sales, many additional businesses, individuals and craftspeople with their donations to an auction held in June, along with every community charitable organization;

Whereas last week the advisory committee appointed to review used tire options returned a report stating that the province should examine and undertake alternative methods for the disposal of tires other than burning them; and

Whereas we all are well aware that burning tires does not mean recycling tires, yet it took this Progressive Conservative Government over a year of countless meetings and discussions and many taxpayers' dollars to come up with this decision;

Therefore be it resolved that government actually examine viable and environmentally-friendly methods to dispose of nearly 1 million used tires produced in this province each year, and apologize to the people of Nova Scotia for wasting their time and money on a matter that could have easily been resolved one year ago.

Whereas five good Samaritans, four driving motorcycles and one in a van, happened to be in the area and immediately responded by quickly coming to the aid of Sadie Harris to lift the vehicle off her and call 911;

Therefore be it resolved that this House of Assembly extend our appreciation and thanks to the good Samaritans - Dale Mallory, Alicia Martin, Jason Pye, Chris Snooks and Danny Veitch - for acting quickly and decisively during this vehicle mishap by rescuing Sadie Harris from what could have been a terrible tragedy.

Whereas teachers Mary Webber-Cook, Jenny Haggart and Carla MacEachern of Thorburn Consolidated School, engaged the Grade 3 and 4 students in an exercise to plant, care for, and harvest a field of potatoes; and

Whereas Thorburn School Advisory Council member Debbie Wilson conceived the idea and school neighbour Peter Johnson provided the land, tilled the field and minded the crop during the summer; and

THE PREMIER: Thank you very much to my colleagues, Mr. Speaker, and thank you for the opportunity to rise in the House today to make a few comments and to give a few thoughts on the Throne Speech. Before I do that, I would like to take the opportunity to congratulate you, Mr. Speaker, on your appointment. I know that all members of the House share my confidence in your ability to rule over this House with patience and fairness. (Applause)

I would also like to acknowledge - as was done by the Leaders of the Official Opposition, and the Liberal Party - Her Honour, the Lieutenant Governor, for delivering the Speech from the Throne, and also the MLA for Hants West and Victoria-The Lakes, who

moved and seconded the Speech from the Throne as read by Her Honour, for doing a fine job, I might add.

Mr. Speaker, we are very fortunate to live in this province, the greatest province in the country and the greatest country in the world. We're able to do so because of the brave men and women who serve our province, many who come from our province, and serving in various parts of the world for peace and democracy, and I salute each and every one of them here tonight. (Applause)

Nova Scotia is as much a community as it is a province. It is home to caring, hard-working people, a natural beauty, and it is filled with opportunity. Our vision will take advantage of those opportunities. We will do that by focusing on the five priorities as outlined in the Throne Speech - educating to compete, protecting our environment, better roads and infrastructure, safer, healthier communities, and shorter wait times.

I have heard a lot of things said over the past number of days about the Speech from the Throne, some I agreed with, and I must be honest, some I didn't. I know it comes as quite a surprise, but the Opposition really didn't have that much good to say about the Throne Speech, but listen to what people around Nova Scotia are saying about our government's five priorities and you will get a much different view than those from the other side.

We are educating to compete, and we're able to do so by having more universities per capita than anywhere across other provinces, and by having a community college system which is the envy of all others across the country, and parents, teachers and students who are making our Primary to 12 system the success that it is today.

The very day after the Speech from the Throne, the Canadian Federation of Students said it welcomed the government's direct-lend program on student loans. The organization told the media, "It will mean that students will be saving money." That's what we're hearing out there.

Mr. Speaker, we will help our students save more money. We are listening to students' concerns about tuition and the cost of borrowing. We will continue with our commitment to reduce tuition costs for our students and improve assistance programs. The Minister of Education has already begun the feedback gathering from our students across Nova Scotia.

We recognize that not all students choose to go to university. Many will become, and have become, skilled tradespeople. I know, I come from a family of skilled tradespeople and I'm very proud of that. We are helping them to do that because they are the people who build our province on a daily basis. We are working to raise the number of certified tradespeople through various apprenticeship programs, moving forward on the next phases of the

community college plans and upgrades, while investing in such programs in our Primary to 12 system such as Options and Opportunities.

Mr. Speaker, we know as a government, the high Canadian dollar and high energy prices are having an impact on our fishermen, our farmers and our forestry workers. I heard that message today while in Yarmouth, while they were getting ready to move forward on the traps. I heard that message on the weekend when I dropped in to see the good people of Sheet Harbour.

Mr. Speaker, these traditional industries have long been the backbone of the Nova Scotia economy. We recognize and we value their importance. That is why we invested another $37 million in the forestry sector in our province.

Mr. Speaker, that's why our agriculture budget was increased this year by 15 per cent and we moved forward with the Buy Nova Scotia Buy Local program, Select Nova Scotia, Mr. Speaker. As the Minister of Agriculture from the beautiful Colchester-Musquodoboit Valley often says in this House, farmers feed us all.

Mr. Speaker, the people in these industries continue to come up with new ideas and new business plans to compete in an ever-changing global economy. The reality today is we do have an ever-changing global economy and we recognize that and we will continue to work with them and we will continue to support them.

For some workers, these changes will mean learning new skills. Our new Department of Labour and Workforce Development will work with the people of our province to make sure they are able to stay here in Nova Scotia and help build our future.

Now, Mr. Speaker, building that future means protecting our environment. Again, another one of our priorities which the Minister of Environment, I might say, is more passionate than any minister across this great nation of ours when it comes to the environment.

Now again, some members of the Official Opposition can't find anything good to say about our plans. Quite frankly, Mr. Speaker, they are out of touch with those closest to this issue. Take, for example, the designation of the Blue Mountain-Birch Cove lakes wilderness area, a great initiative for the people of our province.

Now while the Official Opposition was clamoring for press, environmental groups were congratulating us on taking the lead in protecting our environment. Here is what the Canadian Parks and Wilderness Society said about our plan, and I quote: "This is the single most important thing the province could have done to protect the ecology of the Blue Mountain-Birch Cove Lakes area". That is what they are saying out there, Mr. Speaker.

It seems that the NDP really is alone in the wilderness on this particular issue, Mr. Speaker. Now I assure you, our work on the environment is only beginning, including such initiatives as our coastal management framework which we'll move forward on in the next two years. We will take advantage of the best wind conditions in the country and the highest tides in the world in the Bay of Fundy. These factors will help us reach our target of becoming the cleanest and greenest province in Canada.

Mr. Speaker, the task ahead is great and it requires our full attention. Hence, we will establish a Department of Environment to ensure that we are prepared to meet the environmental challenges coming our way, and we know there are challenges coming our way.

Now simply put, Mr. Speaker - and I know that all members of this House see this on a daily basis in their own ridings, I see this in my own riding - simply put; our province has an infrastructure deficit. We need better roads, schools, hospitals, recreational facilities, libraries and Internet connections. That is why we have made better roads and infrastructure one of our priorities as a government.

Now, Mr. Speaker, I know you don't hear this from the other side but the work is already underway. In fact, the Minister of Education and I today took part in the official opening of the $32 million Halifax Citadel School, just up the hill from here, today. One of many accomplishments of our government, Mr. Speaker.

Just a couple of weeks ago we announced a deal with the federal government worth over $600 million, while in Antigonish (applause) - Mr. Speaker, while the Official Opposition would chide us for having a positive relationship with the federal government, the people who use our roads and buildings or who log onto the Internet, are encouraging us to continue with our hard work by getting those dollars. It is that type of hard work which saw us get a deal in the Atlantic Accord and will see this province become, and continue to remain, the full beneficiary of our offshore for the people of Nova Scotia.

Mr. Speaker, in speaking about the announcement, which was attended by my honourable colleague, the Deputy Premier, in Antigonish, as well as the Minister of Transportation and Infrastructure Renewal, the Nova Scotia Chambers of Commerce said this, "The deal will help shore up some of our infrastructure needs. We will also see a direct connection to the Atlantic Gateway with the increased twinning of Highway 104, which will benefit our entire province." That is what people are saying out there.

Again, Mr. Speaker, the Official Opposition is on the road to nowhere when it comes to this issue in their criticism. (Interruptions) Some would question the idea of strategic infrastructure partnerships, which we talked about in our Speech from the Throne.

MR. SPEAKER: Order. Order, please.

THE PREMIER: We have an excited bunch tonight, Mr. Speaker.

MR. SPEAKER: Order. I realize everybody is well rested after the weekend, but we need some quiet so we can hear.

THE PREMIER: Mr. Speaker, I tend to be generating some interest from across the floor.

Some would question the idea, as I said, of strategic infrastructure partnership. Now, we are using those partnerships now and if we want to provide more services for our fellow Nova Scotians, those partnerships need to grow. Remember that the next time you see an ambulance because Emergency Health Services is a great example of how we can work strategically with the private sector to improve our services. Mr. Speaker - it's a great example. I think it is only fair that I acknowledge the work of the previous government, before 1999, for putting that plan in place. They deserve the credit for doing that.

Mr. Speaker, it's working all across our country, from the Confederation Bridge here in the Maritimes; to the John LaBatt Centre in London, Ontario; to the Kelowna Skyreach Place in British Columbia. There are those who would criticize that, but I believe we need to take an increasing look at those opportunities, provided we do it in a sensible way, provided we do it with the appropriate filter in place.

Mr. Speaker, I lost my place for a moment. (Interruption) Now I remember, how could I forget this. There would be those who would put (Interruption) Again, they are quite excited on the other side.

Mr. Speaker, speaking of the Official Opposition once again, there are those who would put a halt to development. I know you find that hard to believe here in the downtown. There are those in the Official Opposition who have derailed plans for new buildings in downtown Halifax - this despite widespread support from business leaders who recognize the need for more office, retail and living space. (Interruption)

There is no question that we, as a government, and we, in this Party, are proud of our heritage and our culture, Mr. Speaker. There is no question about that. (Applause) It's why we have increased our support for heritage in Nova Scotia; it's why we are going to double the amount of money we put into culture in Nova Scotia over the next three years. That heritage can't prevent us from looking to the future and building our economy and we will ensure that we have that balance, unlike the other side, when it comes to that issue.

Switching topics, something that is very near and dear to my heart and I know it's very near and dear to many in this Chamber, is that of the opportunities that we see with

Atlantic Gateway, and you have to look no further than out here with the Port of Halifax to see the opportunities. It will benefit people from Yarmouth straight through to Sydney.

We know that we have a great opportunity to attract ships from Asia and India, and when they come through the Suez Canal, the Port of Halifax, the Strait of Canso Superport, Sydney and others will be ready to unload those containers. We have deep water, we have ice-free ports and not only that, more importantly, we have the talent here in our province that can deal with this issue. Every time a container is taken off one of those ships it creates 4,600 hours of work, thousands of jobs will result from the plan that we are doing and moving forward upon in the future.

The future is upon us and it is up to us to make sure we take and are ready to take advantage of it. Our focus on better roads and infrastructure is proof that we are ready. While ensuring that our communities grow economically, there is no greater need than to make sure our communities are safe and I know my honourable colleague, the Minister of Justice, knows that and he knows that in his own community. I know the former Minister of Justice and Attorney General - who did a fine job I might add, while minister - as a former police officer, he recognizes that and the good people of Cumberland County who have been very supportive of this government. That is why safer, healthier communities is one of the other priorities for this government on this side of the House.

We are putting more police officers on the street, we are forcing drug dealers out of our communities and we are implementing all recommendations of the Nunn Report, and we are fighting for tougher changes to the Youth Criminal Justice Act, and we are calling on our federal government to do so.

As one example, we believe hospitals have a duty to report gunshots and stabbings to police. Even the most staunch critic of my government was forced to admit it was a good idea. The President of the NSGEU told the ChronicleHerald that our legislation could make for good policy. Speaking of hospital staff, she said, "It kind of really takes the onus off of them because they'll have to report it now, rather than wondering if it should be reported". Now if the Leader of the NSGEU is convinced that we're doing the right thing, I'm fully convinced it must be right. I'm sure that quote will be brought up to me at another future time.

The Opposition Parties say that our legislation aimed at making our streets and communities safer is too broad. I say by improving crosswalk safety and putting strict penalties in place for street racing, we are showing the type of leadership that Nova Scotians expect and deserve from their government.

Of course, making our streets and communities safer and healthier is about more than crime prevention. It is about making sure Nova Scotians have jobs and access to medical treatment and we are doing that. The number of Nova Scotians living in poverty has fallen

by 35 per cent between 1996 and 2005, 65,000 more Nova Scotians are working today than in 1996, those are results, and we now have the lowest unemployment rate in a generation, those are results.

Thousands more jobs mean more tax revenue, money that we continue to put into new social programs and continue to invest in important social programs. We recognize that there is a balance. Today perhaps, we rise to a better example. I join the honourable Minister of Health, Mr. Speaker, whom I also might add is doing a fine job on behalf of the people of Nova Scotia - I join that honourable member today, for today this government and our Party delivered on a platform promise and I might add that we are the only Party to do so. We will make sure that through the Nova Scotia Pharmacare Program that every single person in our province will have access to prescription drugs. (Applause) We have 180,000 people who don't have private drug plans and in our Nova Scotia, no one will be left behind, I can assure you of that.

Now, Mr. Speaker, a key component of healthier and safer communities is providing quality health care. When we start to talk about health care, we hear about wait times. We recognize that wait time are too long and we've made shorter wait times. (Interruption) Now, the Official Opposition claps for longer wait times. I certainly don't, Mr. Speaker. Now, when we started talking about health care, we recognize that shorter wait times need to be a priority and, in all seriousness, that's why we have put this forward as a priority. I know that each member of this House faces this issue regardless of what area they represent in Nova Scotia. The proof of that is certainly evident.

Now, Mr. Speaker, let's talk about some of the things our government has done. The ground is broken on a $17 million emergency room at the QE II, here in Halifax. Construction is underway on a new $155 million hospital for the good people of Truro and Colchester. The Valley Regional Hospital is being expanded. New MRIs will cut wait times in half. New digital screening units allow for mammograms for twice as many patients in any given day and there will be a wait time guarantee for cancer radiation therapy. I know that many of us have been touched in one way or another by what is an awful disease.

Now, while the Opposition members say they have a plan - with wait times, they actually don't say how that plan would be implemented. They don't say how much that plan would actually cost, nor do they say how much taxes would have to go up for their big ideas. (Interruptions) That's what they're not telling the people of Nova Scotia and do you know what, Mr. Speaker, the good people of Nova Scotia deserve to know the truth and they deserve to know what the plan really is. (Applause)

MR. SPEAKER: Order, please.

THE PREMIER: Mr. Speaker, our plan is based on reality. We made real commitments and we're delivering on those promises. We have more doctors per capita than

any other province in the country. More nurses are coming to our province and 80 per cent of our graduates are staying at home upon graduation. We are opening more beds for seniors throughout out province. In fact, we'll open over 800 more beds because we recognize that we need to free up many of our acute care beds in Nova Scotia because it is a problem and, yes, my government and I will be the voice for mothers and fathers, sons and daughters of seniors, and those with special needs, while being fair to our workers by ending strikes and the potential for strikes in our health care system.

Now, Mr. Speaker, there is something that I do agree with the Leader of the Opposition on - I do agree with him on something. It appears he was absolutely correct when he announced in this House on Friday, and I quote, "that Nova Scotia has the best health care system in the country". I absolutely agree with him.

Mr. Speaker, remember our five priorities; educating to compete, protecting the environment, better roads and infrastructure, safe, healthier communities, shorter wait times. I'm proud of our vision for the future and I believe Nova Scotians share that same pride and vision for our province. (Applause)

The honourable member for Cole Harbour-Eastern Passage.

MS. BECKY KENT: Thank you. Good evening, Mr. Speaker, thank you all. It is with great honour and pride that I stand before you this evening in this historic Chamber with my mom and dad present, to offer my remarks on behalf of the people of Cole Harbour and Eastern Passage.

Mr. Speaker, the residents of this riding elected me on a memorable day, October 2, 2007. I take this role very responsibly. The residents of the riding know that I will do everything I can to do my best for the constituency, 24/7. (Applause)

I akin it to being like a parent - one must keep their eyes and ears open all of the time for signals of need of support, celebration and reinforcement for a job well done, challenging inappropriate behaviours, nurturing and sometimes just offering a shoulder to cry on. These are the things that I will do for those who are in need, at the same time advocating for provincial change for the betterment of not only the communities that I serve but for the entire Province of Nova Scotia. I took an oath to do this, an oath that I believe in strongly and I hope to work selflessly for the betterment of others.

I'd like to take a moment, Mr. Speaker, to thank Her Honour, the Lieutenant Governor, for her presentation of the Speech from the Throne. It is an honour to be part of

this Assembly during her term. It is also an honour - you confused me a little because you switched (Laughter) - an honour to congratulate you on your appointment to the Deputy Speaker (Laughter) and, of course, to the member for Cape Breton West for his appointment as the Speaker, and the honourable member for Cape Breton North, your predecessor, for offering the kindness and welcome that was very well received. I appreciate that very much. The Speaker, as well, has done a great job so far, from me, for what its worth - a job well done. You've been good to me so far so please keep up the great work.

Before moving on to thanking people within my riding and talking about my riding, I want to take a moment to express and offer experience of my serving on Halifax Regional Municipality. The members of Council and staff treated me with kindness and respect at every moment from the moment I was elected. It was a steep learning curve for a stay-at-home mom and a small- business woman, to learn the details of providing for a functioning and successful municipality. It was challenging and rewarding at the same time. People often asked me, how did I like my job? Quite often they were surprised, I said I loved it. I did and I do.

I didn't envision myself in that role; nonetheless, the residents of District 8 Woodside and Eastern Passage had enough faith in me to represent them at Council and I thank them all for giving me that opportunity and experience. Mr. Speaker, it's not easy making decisions of any level of government but a municipality of this size faces particular challenges. The capital of the province, it comes with specific expectations for the citizens of all of Nova Scotia. It is often taken for granted. I am proud to have been part of that for the past three years. All municipalities across this province face challenges that are particular to their areas and I look forward, as the Critic for Service Nova Scotia and Municipal Relations, to being a strong voice for those municipalities and getting to know them around the province.

Mr. Speaker, at this time I am compelled to offer a few more thanks, but I would like to give you notice that I have much to be grateful for so I will be a bit long-winded on this one. (Interruptions) It was a bit foreboding, coming from five minutes in council to an offering for an hour, but my kids have often told me, I'm never short on words.

I am completely humbled by the amazing support shown to me during the election, the by-election in October. The community came out in spades to say that Becky can do the job at Cole Harbour and Eastern Passage. (Applause) Supporters came from around the province. The headquarters was buzzing every day with well wishes, food being dropped off, donations, canvassers - you all know the drill. There was never a shortage of help throughout the five weeks of campaigning.

Mr. Speaker, the residents of Cole Harbour, Eastern Passage, Cow Bay, Shearwater and Bissett Road were all part of this team. The Cole Harbour-Eastern Passage NDP Riding Association is alive and well and thriving and supportive of their newest MLA. Members like

Debbie and Wilbur Williams, Gary Healey, Sue White, Brian Birt and Kim Byrne, to name a few. I thank them for their continued believe in the NDP. Of course, I need to thank my colleagues in the NDP caucus for their often genuine welcoming to the fold. Our incredible Leader of the Opposition and member for Cole Harbour is leading a formidable team, to which I am honoured to be part of. (Applause)

Our future is very bright and I look forward to working with you all. Specifically, I owe a debt of gratitude to David MacKenzie for being my campaign manager. One time, actually more affectionately referred to as my campaign weasel by a local radio show host, (Interruptions) David was quiet and thoughtful, which sometimes was in stark contrast to my exciteable and sometimes energetic approach but we balanced each other well. Other people who certainly were instrumental in the day-to-day work of the campaign were Gary Healey, Margaret Logan, Sue White, Brenda Moores, Holly Brown and Brian Birt. I could not have gotten through it without their help. So, Mr. Speaker, I thank them again.

Two young New Democrats that I want to mention specifically are Jeff Mallette and Will Muise. These two young men are completely engaged in their community, Mr. Speaker, and they are both role models for their peers. I especially thank them for being proof positive that the youth of communities have much to offer and contribute. Nita Lyle and Diana White are two lovely ladies who have shown me, personally, such caring. They were always there looking at me, looking at my eyes, looking just at how I approached the day, on a personal level, making sure that you just didn't tire out and you always had the well wishes and the words of encouragement to go on and I thank them so much for that. Sometimes, getting up, you avoid the mirror during a campaign. You just want to keep going and keep you head down and get the job done and they were instrumental in that.

Of course I have to express, Mr. Speaker, my gratitude to the former MLA for Cole Harbour-Eastern Passage, Kevin Deveaux. He saw something in me and many years ago encouraged me to run for municipal councillor. When the time was right, Kevin nurtured me along to help me be the best that I could for their communities. Thank you, Kevin, for being a great friend and peer. Meghan, Ewan, Falvie and Kevin are on an adventure of a lifetime, an experience that will change peoples lives for the better. I wish them every success in Vietnam. (Applause)

Of course for any of you who know Kevin, you would also be aware of his dad, Jeep Deveaux. A huge thanks goes to Jeep. Jeep has taken me under his wing and often referred to me as like a daughter. He is a resident of Eastern Passage who is in his senior years but somehow shows more energy, drive, and passion for his community than people half his age. Jeep is a shining example, Mr. Speaker, of what all seniors in our province deserve to be - vibrant, healthy, and engaged citizens.(Applause) Jeep of course will continue to visit our constituency office with issues written on a napkin, bringing forward, making sure someone is paying attention, and we will all be the better for it. I thank Jeep, Mr. Speaker, for being Jeep.

I have to spend a few minutes of course on my partner, Darren Lightfoot and my sons Isaac, Tyler and Matthew. Without their support I could not be here. Darren is my best friend and confidant. When I first talked about getting involved in politics, I spoke with my sons about it. Their response was, of course you should do this Mom, it's perfect for you. What mother could have walked away from that support? To know that my sons were paying attention enough to recognize my strengths and encourage me to pursue a goal that included doing something for my community. It is a blessing and it's a sign of a connected family.

In times of these busy schedules and so many influences in our lives, both positive and negative, Mr. Speaker, it's easy to lose sight of each other in a family - even in the most blessed families. There are so many families out there who are not as fortunate. I want what I have in my life for all of the citizens of my riding and for the citizens of Nova Scotia. To have anything less is unacceptable in my books. Before I move away from the thank you's, I want to speak again of my parents, Frank and Vivian Scott of Shelburne County. The member for Shelburne has the pleasure of being their representative and I can tell you they're very proud to say that they voted for him, even more so now.

My mom and dad are a typical family in this beautiful Province of Nova Scotia. They've raised six children in a rural community. Through goods times and then bad, they've continued to strive for what is best for their family and for their community. I came by this honestly - my dad has worked for this province for more than 30 years, my mom was a stay-at-home mom until we were old enough for her to become a personal care worker at the Roseway Manor in Shelburne. They taught me to work hard for the people that I cared for and to be kind to everyone that I came across. They taught me the value of being a part of a family and sharing what you have with those who have not. I can't say enough about the impact that they had on me and subsequently on my children and the people who I come in contact with.

I often relate my experiences as a child - which by no means was always perfect, right mom? dad? - to the scenario of pay-it-forward. As an example of giving twice as much as you received every chance you get to the next person you come in contact with. I thank them, Mr. Speaker, for instilling in me a value that has led me to want goodness for all families of the Province of Nova Scotia.

Now, Mr. Speaker, I'd like to continue on with sharing a bit about the riding of Cole Harbour-Eastern Passage. This riding is the best in the province, in my humble opinion. It has a tremendous - among the best (Applause), I'd concede that. It's my story and I'm sticking to it, Mr. Speaker. It has tremendous history, tremendous people and landmarks.

Mr. Speaker, this riding deserved to be represented and, on behalf of the people of Cole Harbour and Eastern Passage, I wish to recognize the member for Cole Harbour and the Leader of the Opposition and the member for Dartmouth South-Portland Valley for

continuing to provide excellent representation and leadership during an extended wait for the by-election to be called. Clearly, the residents wanted that election but I guess the riding just wasn't quite important enough to call it before the six month deadline. Nonetheless, they are represented now despite the fact that there were people during the election who sent out a message that "Becky Can't".

Mr. Speaker, I am here to tell you clearly that they missed the boat on this one. Somehow, somewhere, they got the impression that this election was about a single person. The author of this message and those who endorsed it seemed to miss the true meaning of what being an elected representative was all about. Being a voice for your community. No one person can get the job done for a riding. It takes all of the residents to work with their MLA, Mr. Speaker, to communicate loudly, advocate for what is right, share their stories, work on behalf of the community.

No one person can get a high school for Eastern Passage; it will take a community voice to get the job done. It will take leadership from a government that sees a community in need - overdue in need, in fact more clearly. Leadership from a government that will make sure that the right thing is done.

Mr. Speaker, no one person is going to get a health facility for this riding. It will take a community, of which I am one player. It takes a responsible government, however, not a government that will endorse messages during an election campaign that if you don't elect their Party, you won't get anything for their community. What kind of government would hold a riding hostage like that? The riding of Cole Harbour-Eastern Passage and the Province of Nova Scotia deserve to have better and I look forward to making that happen.

Mr. Speaker, I'd like to take some time to show you a little bit of Cole Harbour and Eastern Passage, what it is currently like. It is beautiful, to say the least. It has its challenges, of which I'll speak on a bit later but for now I want to highlight the positives, what you would find if you visit our riding. As you wind your way through the streets of Cole Harbour, you'll be flanked by Bissett Lake, Morris Lake and the Shearwater Flyer Trail. Cole Harbour has the benefit of hosting many topnotch athletic fields, parks, playgrounds, trails, schools, First Nation Communities, churches, community groups.

The Cole Harbour Parks and Trails Association has been successfully developing the Rails to Trails Program in the area for several years. Under the held of Jim Tudor, the Salt Marsh Trail and the Shearwater Trail now connect to Shearwater. Bill Stratton, with the Kiwanis have successfully created a tremendous asset known as the Kiwanis Central Beach Park at Morris Lake. Efforts to provide an accessible park for all ages and abilities have come to reality and I congratulate them, Mr. Speaker.

Volunteerism is great in Cole Harbour and it's clearly evident in the program for athletes both young and old. They're Girl Guides, the Scouting movement, church groups. Bissett Road also connects Cole Harbour to Cow Bay. The people of this area enjoy their rural setting with access to the advantages of the commercial strip on Cole Harbour Road. Although the residents of this area would love to see transit service, they do value their rural existence and direct access to the nature in their community at their doorsteps - the trails and parks. I look forward to getting to know these residents in their area and to work for them on their behalf and with them.

As you leave Bissett Road, Mr. Speaker, you enter into Cow Bay. Cow Bay is the home of Rainbow Haven Provincial Park, Silver Sands Beach Park and surf park, also known as the Cow Bay Moose Park, and Car Wash Beach. Each of these locations has a particular importance and significant historical backgrounds to this community. Silver Sands Beach Park was a hot spot for vacations at the turn of the century for many affluent Dartmouthians and Haligonians. The Moose Park is still affectionately known as the place where many

families were created and while watching the stars and watching for shooting stars on cold winter nights. (Interruptions) I kid you not.

The coastlines are typical of what Nova Scotia's shorelines are - they're beautiful. An increase in the popular sport and pastime of surfing has been on the rise in Cow Bay. This has brought challenges, Mr. Speaker, but the community along with the Surfers Association are working hard to mitigate the impact on their properties and I congratulate them for that. They took a tough situation and turned it around to be a positive and welcoming sport and athletic destination. I congratulate them.

Silver Sands Conservation Society, Mr. Speaker, with members such as Elizabeth Quint, Donald Hudak, and Todd King, just to name a few, are watchful eyes for the protection of the natural environment in this community - the rural nature of the Cow Bay property. Their efforts on many occasions have been successful in sustaining what this community loves and holds dear. The Cow Bay Hall is lovingly tended by many volunteers who work there to maintain this historically significant asset for the future generations of its community.

The Cow Bay loop is connected to the Dyke Road. Although this is a rural setting, Mr. Speaker, ongoing development presents traffic problems that many families struggle with. Some believe that the rural atmosphere is important while others would like to see transit, sewer, water and sidewalks in their neighbourhood. The pressures of development are ever present in this area.

Eastern Passage is bordered by the backlands of Shearwater, the Atlantic Ocean, Hartlen Point Golf Course, Fishermen's Cove along the main road and back to the Shearwater main gate. Mr. Speaker, entering into Eastern Passage from Cow Bay brings you to Heritage Hills, a subdivision that is the host of a P3 school in our community. Schools in our communities are the heart of our communities and access to these schools is what will make our communities thrive, allow them to thrive and grow and continue to sustain that sense of community that many places are losing. Access to the schools in our P3 schools is almost non-existent. In our P3 schools, we have tremendous staff and administration through the Halifax Regional School Board but to get gym time, to get into the auditorium that is state of the art, just to get on the fields to play soccer is nearly impossible, at the cost that's outrageous. When a community is sustaining those costs, fundraising for so many things, it's unacceptable, this day and age, in this province, that we should have to face that, Mr. Speaker.

The heart of Eastern Passage is proud of three other schools; Seaside Elementary, Oceanview, and Tallahassee Community School. They are connected by our Eastern Passage Commons, which provide baseball fields, soccer fields, and community fair grounds. The Eastern Passage Athletic Association is instrumental in providing those programs and we thank them.

Mr. Speaker, volunteerism is also strong in these communities. Notable organizations like the Buffalo Club - with members like Tony Ozmond, Richard Deyoung, Bill MacArthur, Troy Popkee, just to name a few - keep this club active, productive and contributing to our community in more ways than most people will ever know. Thousands of members have been in that club for the past 50 years and many people just have no idea how much they've contributed and we thank them.

Although many Lions Clubs are closing their doors, the Eastern Passage Lions Club is still thriving. King Lion, Peter Reed, leads his volunteer team in many benevolent activities such as Adopt-A-Highway and the Seeing Eye Dog program, for example. The Caen Branch of the legion continues to honour its veterans and all of the members of our Canadian Armed Forces. The Girl Guides of Canada and Scouts Canada offer programs to the youth in the riding. Special thanks to those who get involved often because it's their child, they want to have time with their child and their busy schedules.

These leaders so often end up being a key instrumental person in the lives of so many other families and I thank them for that. They are tremendous role model leaders such as Donna Mitchell, Elsie Foley, Cindy Morash, Jennifer Irving, Darren Lightfoot, Steve MacKay, Mike Gingall, Keegan Gingall, Jim Logan, Steve Matheson, Julie Wilson, Peggy Keans, Greg Dalzell, Joel Rafuse, Gerald Gerioux, Adam Mason, and Patrick Power. They are just a few of those who are active in the scouting movement and the Girl Guide movement in our riding. I was a member for Scouts Canada for 10 years, so these people certainly have a special place in my heart and I thank them. A special occasion and a perfect example of what it's like to be a volunteer in the community - we have a tremendous event coming up on the weekend of December 2nd, a community tree trimming event celebrating it's 18th year. We have the benefit of the Conserve Nova Scotia LED light exchange added to it this year and we're thankful for that.

Economic development is vital to all communities in Nova Scotia. Cole Harbour and Eastern Passage is no different, the commercial areas of the riding are growing, which is good news. General Dynamics is offering new jobs in the Cole Harbour Area while new businesses are opening at Government Wharf Road like Seagulps - that's a coffee shop. It was voted number one coffee shop in Dartmouth recently and we congratulate them. Fisherman's Cove is alive and well and thriving. Eastern Passage Business Network is a new network, recently formed to help small businesses in the community link offer resources to each other to aid in their success. There's a working balance, Mr. Speaker, between tourism and the fishing industry in Eastern Passage, but our fishermen need government support. Family-based fishermen must have access to their fair share of the quotas. With the high value of the Canadian dollar, they'll need government support in securing other markets that are less impacted by that high value - and Eastern Passage fishermen know that all too well.

I want to tell you about our seniors in our community. They are vitally important to us. Many of them still live in their own homes; many are living in seniors housing complexes

like Island View Manor and MacDonald Manor, and some at a long-term care facility, Ocean View Manor - one of the finest in this province. Mr. Speaker. I have the honour of being on the board at Ocean View so I am familiar with the need of support from the province for this and many facilities across this province. The wait list for these facilities is too long; any wait is too long, in my opinion. Our seniors deserve to be cared for and to be living in their communities with their friends and their loved ones. Whether in long-term care or living at home, support from our government is critical for their quality of life.

The challenges of aging are numerous and sometimes monumental. Between health care gaps, home care support and increasing taxes sometimes forcing them out of their homes prematurely, seniors in our province need our help. Families caring for their elder loved ones need our help. This message is one that I heard loud and clear on the doorsteps during the election, Mr. Speaker. Recognition of these issues and offering the resources to meet these needs is a must-do for any government.

I truly hope that this is part of the vision of the new Nova Scotia that is being put forward - I hope. But once again, it can't be in the year 2020. Our seniors are here and they need help now.

Our riding is proud to be the home of the Canadian Forces Base Shearwater, one of Canada's largest employers in the metro area. There has been, in the past, a fear of closure of this base but recently, in the past couple of years, the federal government has committed significant amounts of funding, which has achieved a Fleet Diving School and the Nova Scotia Community College helicopter training facility, which is currently under construction.

I have had the pleasure of working with the former Base Commander, Colonel Allen Blair. He was a tremendous friend to the community and worked side-by-side with myself as the Councillor and Kevin Deveaux as our MLA. Recently, the Base Commander has changed to Colonel Bruce Ploughman. I'm proud to say that he is a resident of our riding so I am confident that he will be as friendly a face to the community of Eastern Passage, Cow Bay and the rest of the riding and he will keep their interests at the forefront of his decisions as much as did Colonel Blair. My best wishes go out to Colonel Blair as he begins the next stages of his career and I welcome Colonel Ploughman.

Military presence in our riding is no stranger to our communities. Many servicemen and women settle in our communities to raise their families. They know they are settling in a community where they are valued, honoured, respected and supported. They are our families, our friends, our loved ones, our school mates, our Curves partners, our Seagulps and Tim Horton's coffee buddies. They know that this community is there to help them when they are in need and are facing the challenges that often come with the loved one making the ultimate sacrifice of defending our country and fighting for peace, Mr. Speaker.

Deployment to distant lands comes with tremendous burdens, ones that our community will share the load. This is the kind of community, Mr. Speaker, that I have chosen to raise my family in; this is my wish for all Nova Scotians.

I'd be remiss if I didn't mention the jewels in our harbour, McNabs Island and Lawlor's Island. Local friend of the island, Captain Red Beard, Mike Tilley, and a new ferry service - Taylor Made Tours operated by Steve Taylor - is finding lots of interest, Mr. Speaker, in these islands. A great big thank you goes out to the Friends of McNabs Association. Cathy McCarthy has been leading a team of volunteers in the preservation and protection of these lands for many years.

It is worth noting, though, that they are becoming increasingly frustrated, Mr. Speaker, with this government's lack of interest in this island. They welcome the process for creating a long-term plan for the island and the release of the document with significant plans for restoration and development of the wharves and the parkland. It is not good enough to say that you have a plan and then leave it on the shelf to collect dust.

This work is not only important to my riding, it's important to Halifax Regional Municipality, and it's important to the Province of Nova Scotia. This is a historically- significant site that must have funding allocations to support this plan. This plan was well thought out and it included the stakeholders, such as Friends of McNabs and residents of Eastern Passage. It deserves attention, Mr. Speaker, and I look forward to seeing that.

Residential growth is ever present in the riding, many new developments are happening as we speak, literally. Halifax Regional Municipality's 25- year regional plan has designated an area of growth in and around the Morris Lake area, this is directly behind the Shearwater Air Force Base and joins the communities of Cole Harbour and Eastern Passage within the riding.

Of particular importance to the growth is the infrastructure, or lack of. Roads and transportation are critical to the success of these communities. The traffic on Caldwell Road and Cow Bay Road continues to contribute to speeding issues, crosswalk safety, deteriorating roads and transportation gaps, all of which could be more easily dealt with by appropriate funding from this government to the municipality. Transit connection and service to and from Cole Harbour and Eastern Passage is long overdue; increased transit service to Cow Bay and Bissett Road is also long overdue. It's not a shock, Mr. Speaker, to hear that there is further need for transit funding, road infrastructure funding, trail development and maintenance funding, and funding for partnerships with HRM to see the completion of the Caldwell Road Connector.

Healthy and active lifestyles are critical to the well-being of all citizens of this province, so it will come as no surprise that the people of Eastern Passage will be mobilizing

to work with the three levels of government to create a health and recreation facility for Eastern Passage.

As well, there is a tremendous amount of work being done by the Cole Harbour Parks and Trails Association on the Shearwater Flyer - as I mentioned earlier - the Salt Marsh Trail, and parklands, but this local community effort is only part of the picture. Maintenance funding is critically important to the sustainability of these infrastructures, these trails, and the lasting effects that they will have on our families.

We all know, Mr. Speaker, that education is on the minds of all the families in the province. Education funding must be increased to the levels that our school boards need to responsibly provide for the education of our children and our youth. The ongoing maintenance funding gaps and aging schools is at a critical point in this area. The Halifax Regional School Board is currently undergoing - as directed by the Minister of Education - a 10-year plan. It sounds exciting and sexy, but what is the reality of this for the residents of Cole Harbour and Eastern Passage?

The reality is that the families of Eastern Passage and Cow Bay have been in need of a high school for more years than I can remember. After being promised a new school by the Liberals roughly 12 years ago, then, at the eleventh hour, the political will of the day took it to Auburn Drive. The reality is, that in the recent by-election, the message came out loud and clear to the people that if they didn't vote for a Progress Conservative candidate, they would never get a high school from our government.

The reality is that, finally, last year, after many years of advocating with the Halifax Regional School Board, we finally were on a list of priorities for new schools. That list was sent to the Minister of Education for consideration. A new high school for the Woodside/Eastern Passage area was recommended on that list. Finally, there was some hope for families. Then, go figure, the minister decided that she didn't like what she was seeing, but rather she would like the school board to waste another year talking about the schools that should be built, closed, or fixed for the next 10 years. So forgive me, Mr. Speaker, if I can't share in the enthusiasm and excitement of today's celebration at Citadel High School.

A 70-person committee struck under the guidance of an Upper Canadian consulting group who, frankly, Mr. Speaker, knows very little of the families in our area - one would think that we don't have a Nova Scotia firm that could do the job - nonetheless, it's taking place right now. Don't get me wrong, I congratulate and I thank every one of the people who are volunteering on that committee because I know they are out there working hard. They are doing the best that they can and what they honestly feel for their communities, but I challenge this government for the changing of the rules mid- game. I am not confident that this new set of rules is in the best interest of our communities, but I will keep an open mind.

I will put faith in this committee to see the benefits to the communities of Eastern Passage and Cow Bay of a new high school that will allow our children to get up at a reasonable hour to get to school, not at their current 6:00 a.m. wake-up call for 750 students to be bused to Cole Harbour and provide three-quarters of the population at Cole Harbour District High School; I will put faith in this committee in seeing the benefits to the youth of the community who miss out on opportunities to partake in school sports teams because they don't live in the community where the sign is being posted for tryouts, or where they miss out on opportunities for part-time jobs; I will have faith in this committee to make sure that the youth of our community are no longer attending a school that is overcrowded, where they rub shoulder to shoulder every time they walk in the halls before and after school - these are just a few of the challenges that will change when a new high school comes to Eastern Passage.

I have faith in this committee that it will, once again, send a list of schools to be built to the Minister of Education with a recommendation of a high school and the current minister will finally do what the community has been in need of in this province. As one resident recently said to me at an Imagine Our Schools public meeting, Mr. Speaker, it's time to take the politics out of this decision - so I ask the Minister of Education to hear her message loud and clear.

Crime in our neighbourhoods, Mr. Speaker, is also a concern for the residents in the riding. It's not news to anyone. The Speech from the Throne mentions a few new measures to fight crime and I'm grateful for that, but what is needed in crime prevention . . .

MR. SPEAKER: Order. Order, please. I would certainly encourage those who want to carry on some discussions to take it outside the Chamber so we could allow our colleague to be heard in the Chamber. Thank you.

MS. KENT: What is needed, Mr. Speaker, in crime prevention is what will get at the root causes of crime in our communities. This government must start addressing the causes of crime to successfully reinstate the sense of safety in our communities. Many local organizations are doing just that.

YACPAC, Youth and Community Partnership Against Crime, is a grassroots level community organization in Eastern Passage under the leadership of Judy Lightfoot. Judy's experience in the Department of Youth Justice and her current role at the IWK brings a tremendous asset to this local organization and it has much to be proud of. This group has surveyed the community, the youth of the community, and they heard loud and clear that there was a need for a skate park, so they proceeded to make it happen; they heard from the youth that there was a need for a drop-in centre, so they are actively working on it; and they recognized that they would need a working space for a recently reinstated RCMP community officer, so they provided the space. They have established neighbourhood watch groups and citizens on patrol groups in the community. This work is ongoing and I'm sure the same

types of work are being done in many communities across Nova Scotia, but they can't do it alone.

YACPAC receives funding from a federal crime prevention program that has recently been cancelled - now they are left to their own devices to raise the money to continue their work. Safe communities are not all about adding police officers. More police are wonderful, but a partnership approach is what will change the direction of many of our young people in our communities away from crime and towards healthy, engaging choices. Root causes can be worked on from a local level with support of the government. There are many groups and organizations out there that are doing great, vital, effective work and we must support them at every opportunity.

The citizens of Cole Harbour and Eastern Passage are asking for these issues to be addressed, not unlike all the residents and citizens across this province. I am certainly looking forward to seeing what the current government plans to do with these gaps in their vision for a new Nova Scotia. As I wrap up my speech, I was a little worried that I wouldn't have enough material, but I would be happy to meet with any and all of you to continue these discussions, to hear about what's important to the riding of Cole Harbour and Eastern Passage and where I have the privilege of bringing these issues forward to this government.

In conclusion, Mr. Speaker, we are celebrating 250 years of democracy in this province. I ask this House to work with me to ensure that the people of this province can say with pride that they are happy to celebrate democracy because it is working for them. Thank you. (Applause)

MR. SPEAKER: The honourable Minister of Justice.

HON. CECIL CLARKE: I am pleased to rise and move second reading of Bill No. 12, the Evidence Act, the first bill for debate here before the House of Assembly. I know that I look forward to the intervention from our colleagues here this evening. Mr. Speaker, for us, what we wanted to do and achieve with the Evidence Act, which falls out of the Nunn Commission, specifically with regard to the ability to transfer data, it was stated clearly at the time, the ability for the systems to be able to communicate with one another, the system that would be known as JEIN, which is for the administrators within Justice to be able to utilize that system.

Mr. Speaker, one of the things that the Nunn Commission had looked at was the processing time and the ability to exchange data in a timely manner and for the system to be able to respond more effectively. The Evidence Act will enable that process to move forward. Again, I know, as I hear from our colleagues on this, we welcome the interventions; we think this is a positive step forward, and again I am very pleased to rise today to start the process to move this important bill forward as a response to the Nunn Commission.

MR. SPEAKER: The honourable member for Timberlea-Prospect.

MR. WILLIAM ESTABROOKS: Mr. Speaker, it's great to see you in that Chair because the piece of advice you gave me earlier, when you heard that I had become the Justice Critic, you would have thought I had taken a summer school course and I was on my way to become a lawyer. Let me clarify, Mr. Speaker, it is with great honour that I accept the responsibility to be the Justice Critic for the Official Opposition. It's a position that I look forward to serving. (Applause) The Leader of the Opposition, when our good friend, Mr. Deveaux, left for Vietnam, at the time I said to him how much I look forward to having the opportunity to be the Justice Critic at some time and now the opportunity has arisen.

It looks like a busy schedule that we have ahead of us and I want to acknowledge the fact that I'm getting lots of great advice, particularly from the Justice Department staff. The Justice Minister, in his briefings that he has had to staff, has been extremely, I should say- and probably the member for Richmond would agree with me I'm sure - patient with the questions from the old school principal who would like to have clarification on various points.

The Nunn Commission was, of course, a monumental piece of legislation brought forward. The Nunn Commission served us all because of the tremendous task which that particular gentleman served to this province. When we looked at what had happened through the circumstances of the entire investigation, there were a number of common sense things which struck me. If a fax machine isn't working, evidence doesn't get transferred. In this day and age, my question at the time, as the Education Critic for the NDP, is, that's no way to do business; so that when I see this first piece of legislation that has been brought forward by the minister opposite, it's a common sense piece of legislation. It allows for the electronic transfer of information in this day and age, something that should have taken place a long time ago.

The members of the media and the members of this House are aware of the fact that perhaps we wouldn't have had some of the problems that we had, that have been brought to our attention by the Nunn Commission; and as a result of that, of the good work done by that particular gentleman, it has been recommended that this be brought forward. So I congratulate the minister for responding to that initiative. It's something that I'm sure that when we go through the Law Amendments Committee, it will be received well by the members of the Bar and it's something which this Party can support. (Applause)

MR. SPEAKER: The honourable member for Richmond.

MR. MICHEL SAMSON: Mr. Speaker, as the Justice Critic for the Liberal caucus, I'm pleased to have the opportunity to make a few remarks on Bill No. 12, An Act to Amend Chapter 154 of the Revised Statutes of 1989, the Evidence Act.

Mr. Speaker, as has been mentioned by the Minister of Justice, in essence this is bringing our justice system a bit more into modern day reality. More and more electronic devices are used to present documents in everyday business and our court system shouldn't be any different. We all hope that these changes are going to allow for a more efficient justice system here in Nova Scotia. As has been mentioned by the minister, this was one of the recommendations that came from the Nunn Commission, which was struck to review the circumstances surrounding the unfortunate death of Theresa McEvoy.

Mr. Speaker, it became quite clear throughout the review of the Nunn Commission that there were problems within our own justice system and the administration of justice here in Nova Scotia. I know that this government has been quite vocal on problems with the

Youth Justice Act and in calling upon Ottawa and the federal government to make changes, but I think what was a surprise to us and to many Nova Scotians is that we had problems internally here in Nova Scotia that were no fault of the federal government and no fault of the Youth Justice Act.

There was a problem in the administration of justice here in our province and, Mr. Speaker, I think it's important that the government realize that and make sure that we're doing everything, as a province, to ensure that our justice system is working for Nova Scotians and not simply trying to blame the federal government and the Youth Justice Act for problems that exist when there are common sense changes that can be made here within our own province.

Mr. Speaker, what I do note of interest is that the Minister of Justice, in bringing forward this bill, was also the former Speaker of this Assembly and my colleague, the member for Halifax Clayton Park, was quite adamant in pushing for electronic petitions being accepted here at the House of Assembly. Unfortunately, in his previous life as our Speaker, that notion was rejected by the Speaker and those changes were not made here in the House of Assembly. So I would certainly hope that now that the Minister of Justice finds himself as a Minister of the Crown bringing forward these changes to allow electronic evidence within our system of justice, that he would also take the time to speak to the Speaker and indicate to him his new desire to now have electronic petitions accepted here in the House of Assembly - because one would think that what's good for our justice system should also be good for the House of Assembly, and I would make note of that.

The other thing I want to remark on as well is that I do note the Minister of Justice, unlike his predecessor and other Ministers of Justice, is actually bringing in pieces of legislation which deal with one specific topic at a time. I was fully expecting this session we would see the 2007 Fall version of the Justice Administration Act, which I've lamented for years. I note that up to now it has not been tabled and I'm told it will not be tabled, but there's still time so I'll wait to see if that's going to happen or not.

The new Minister of Justice is bringing them one piece at a time, but I note that the former Minister of Justice - now the Minister of Transportation and Infrastructure Renewal - has brought to this House Bill No. 7, the Motor Vehicle Act, which actually makes a whole host of changes to a number of pieces of legislation, so while he hasn't been able to bring in the Justice Administration Act, it now appears the same tactics are being used in TIR. Once debate starts on Bill No. 7, I think, and a number of my colleagues in our caucus - and I would suspect in the Official Opposition - will also be raising concerns about that bill and the way it has been presented and the host of changes that are being proposed in that one piece of legislation.

I do want to commend the Minister of Justice and his staff who, I believe, have listened to the concerns that I have raised as Justice Critic. I know that when the Leader of

the Opposition held the post as Justice Critic, he joined me in those concerns and the previous Justice Critic for the Official Opposition before that was, as well, a vocal critic of that approach to putting in so many changes to different pieces of legislation in one bill.

I do look forward to this bill going to Law Amendments - I'm very curious as to what the reaction will be from the Nova Scotia Bar Society, whether they have any concerns with this specific bill or whether there are any changes that can be made to it. Certainly the concept is one that is easy to support, but again we will wait to see what sort of comments we receive at Law Amendments Committee and when the bill returns to this House for further comments on it.

With that, those are my comments on Bill No. 12. Thank you.

HON. CECIL CLARKE: Thank you, Mr. Speaker. I want to thank my honourable colleagues for their comments here this evening, and also in recognizing their acknowledgment of the system and the staff within the Department of Justice and their interaction and their willingness to co-operate.

I would note, when we talked about the JEIN system, which is the Justice Enterprise Information Network, it is used by many entities within the justice system - it includes the judges, the court administrators, police, prosecutors and other justice partners. I'm very pleased to speak to the critics that acknowledged the quality staff because just a couple of years ago the Department of Justice employees received the Premier's Award of Excellence for working on that system. I think it speaks to the quality and capabilities of the professionals within the Department of Justice.

Mr. Speaker, I look forward to this bill moving to Law Amendments and, again, we're open-minded with regard that there are other ways to strengthen this. However, I would like to close debate on the bill. I move second reading.

Whereas Western Counties Regional Library Director, Trudy Amirault, a tireless promoter and developer of library services, was recently named the winner of the 2007 Norman Horrocks Award; and

Whereas Trudy is an articulate and active individual partnering with the Yarmouth Stroke Project as well as the Canadian Mental Health Association to provide the most paramount information to library users, while also having in the past served as vice-chair of the Nova Scotia Community Access Program, while staying involved on many regional, provincial and national committees which has resulted in numerous awards for the regional library;

Whereas in their 100th year of operation, the Ladies Auxiliary of the Yarmouth Regional Hospital was named the Outstanding Volunteer Fundraising Group at the Annual Maritime Philanthropy Awards ceremony in Halifax in June; and

Whereas over the past 100 years the work of the Women's Auxiliary has been felt in practically every aspect of the hospital's operation since their initial meeting on November 12, 1907; and

Whereas since its creation the auxiliary has contributed in excess of $3 million, including a lump sum donation of $1 million in 2007 for the Yarmouth Hospital expansion campaign, quite a leap forward from the initial $449 raised by the auxiliary at a hospital bazaar in 1910;

Whereas Jason Cormier was killed in a car crash a decade ago when a community mourned the loss of one of its top young athletes but thanks to an outpouring of support from the community in the days and weeks following his death, Cormier's legacy and memory lives on in the annual Jason Cormier Memorial Scholarship that's handed out every year to a player in the Cumberland County Minor Hockey Association heading on to college or university; and

Whereas Brittany Herrett was most deserving of this award and is attending Acadia University in Wolfville where she is taking the first year of the school's biology program;

Whereas Deborah MacPhail loves to swim, especially when it's for a good cause, and the academic chair at Nova Scotia Community College's Cumberland Campus in Springhill is 1 of 25 team members from the college who travelled to Greece for NSCC Swim for the College, a fundraiser in support of scholarships and bursaries for students applying to the college; and

Whereas Deborah MacPhail claims that she loves to swim and thought it would be an excellent opportunity to support future students of the college; and

Whereas each swimmer must raise $6,000 in order to go - MacPhail sold tickets on a quilt, took donations and had a community yard sale to raise the money for this event, which will take her to Greece to participate in the five-kilometre stretches between the Greek Islands;

Whereas Royal Canadian Legion Branch 45 was recognized this year for its 75th Anniversary in Parrsboro; and

Whereas there are many veteran organizations in Canada, but the largest by far is the Royal Canadian Legion with over 400,000 members and affiliates; and

Whereas the Legion has focused its efforts on the fight to secure adequate pensions and other well-earned benefits for veterans and their dependants. Acting as an advocacy agency on veterans' behalf, the Legion deals directly with the federal government to ensure ex-military personnel and their dependants are treated fairly and has also assumed a major responsibility for perpetuating the tradition of Remembrance in Canada;

Whereas students at Springhill High School entrepreneur class proved that you can't put a price tag on a good idea. Looking to develop a business venture through the popularity of a lo-fidelity, pink-themed anti-bullying campaign, they soon found the integrity of the original idea priceless; and

Whereas students began brainstorming how they, too, could become involved in the movement that was being emulated at schools everywhere while creating a business venture, however, they soon decided that making a buck off of such a good idea wasn't the avenue the students wished to travel; and

Whereas students wearing pink began to amass outside the Springhill High School and over one-quarter of SHS's student body participated and supported their own pink campaign, lining up to spell out the letters ABC for Anti-Bullying Campaign on the school grounds and the fact that the pink anti-bullying campaign was initiated for students by students are perhaps the key factors in the campaign's success;

Therefore be it resolved that the members of this House congratulate the students at Springhill High School for doing their part in the fight against bullying in the schools and wish them all the best in all future endeavours.

RESOLUTION NO. 148

Whereas James Melanson of Springhill had a dream one night and woke up determined to make it a reality for the young baseball players and his community; and

Whereas Jim Melanson, who has been coaching minor league baseball in the Town of Springhill for 30 years and is a member of the Nova Scotia Baseball Hall of Fame, spearheaded a project to bring the history of the Springhill Fencebusters to life by honouring those who once played for the Fencebusters by having the original names of those players on the new Fencebusters uniforms now being worn by the young ball players in the Springhill area; and

Whereas Jim Melanson has made this dream come true and the young ball players will know facts about the original player whose number they have on their uniform while some of the new players are wearing the name and number of a grandfather or relative who once wore that very same number;

Whereas the children of River Hebert Elementary School wanted to do their part when they recently learned of the plight of others their age and younger children around the world who die on a daily basis from malaria caused by disease carried by mosquitoes; and

Whereas the students were told 150,000 children die of malaria each month and that 15 per cent of Africa's children under the age of five years will die from this dreaded disease; and

Whereas the children asked how they could help and learned that when they buy a bed net for $10, the Canadian Government will match that amount to buy bed nets to keep the children safe while they sleep and each class in the elementary school agreed they would collect coins in a small white bag made of netting on Halloween to collect monies to help the childrenl, this is children caring for children they may never meet, this is humanity at its best;

Therefore be it resolved that the members of this House congratulate the children of River Hebert Elementary School on their unselfish act to help the children in need in Africa and wish them great success in their endeavour.

Whereas lunches were served by the auxiliary to seniors in the village and folks were called on as a way of keeping in touch, also generators were moved from home to home so there would be no freezer food loss, et cetera; and
