An Act to Ensure Public Accountability
with Respect to Unproclaimed Legislation

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Accountability to the People of Nova Scotia Act.

2 In this Act, "Minister" means the Minister of Justice.

3 (1) On one of the first five days on which the House of Assembly sits in each calendar year, the Minister shall table in the House a report listing every Act or provision of an Act that

(a) is to come into force by proclamation; and

(b) is not in force on the day the report is tabled.

(2) A report tabled under subsection (1) must, for each Act or provision of an Act listed in the report, provide an explanation for that Act or provision not yet being proclaimed in force.

4 (1) Where an Act or provision of an Act listed in a report tabled under subsection 3(1) has not been proclaimed in force within three years of receiving Royal Assent, the Minister shall, within the calendar year in which the report is tabled, either

(a) obtain, by way of resolution, approval from the House of Assembly to further delay proclaiming that Act or provision in force for a period of time specified in the resolution; or

(b) introduce legislation to repeal that Act or provision.

(2) The House of Assembly may, by resolution, further extend the period of time specified under clause (1)(a).
