Explanatory Note

This Bill amends the Fisheries and Coastal Resources Act to

(a) raise the maximum fine for an offence from $100,000 to $1,000,000;

(b) raise the maximum fine for a second or subsequent offence from a minimum of $100,000 and a maximum of $500,000 to a minimum of $1,000,000 and a maximum of $5,000,000; and

(c) provide that a person found guilty of an offence is liable to the forfeiture of any licence or lease issued under the Act.

An Act to Amend Chapter 25
of the Acts of 1996,
the Fisheries and Coastal Resources Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 116(1) of Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act, as amended by Chapter 2 of the Acts of 1999, is further amended by striking out "hundred thousand" in the fourth and fifth lines and substituting "million".

(2) Subsection 116(3) of Chapter 25, as amended by Chapter 2 of the Acts of 1999, is further amended by

(a) striking out "hundred thousand" in the third and fourth lines and substituting "million"; and

(b) striking out "hundred thousand" in the fourth line and substituting "million".

(3) Section 116 of Chapter 25, as amended by Chapter 2 of the Acts of 1999, is further amended by adding immediately after subsection (3) the following subsection:

(4) In addition to any fine under this Section, a person who is guilty of an offence under this Act or the regulations is liable to the forfeiture of any licence or lease issued pursuant to this Act.
