Explanatory Notes
Clause 1 requires vehicles operated by employees of the Department of Public Works or a municipality to be treated as other emergency vehicles when the vehicles are stopped on a roadway or a shoulder adjacent to the roadway and exhibiting flashing lights.
Clause 2 allows service, repair or towing vehicles to display red light visible from directly in front of the vehicle and to be equipped to show flashing or revolving red and amber lights in all directions.
An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act
1 Subsection 106D(1) of Chapter 293 of the Revised Statutes 1989, the Motor Vehicle Act, as enacted by Chapter 20 of the Acts of 2009 and amended by Chapter 20 of the Acts of 2014 and Chapter 15 of the Acts of 2018, is further amended by adding immediately after clause (f) the following clauses:
- (fa) a vehicle being used by an employee of the Department when the employee is performing the employee's duties as an employee of the Department;
(fb) a vehicle being used by an employee of a municipality when the employee is performing the employee's duties as an employee of the municipality;
2 (1) Section 179(1) of Chapter 293, as amended by Chapter 31 of the Acts of 1993 and Chapter 20 of the Acts of 2014, is further amended by adding immediately after clause (ba) the following clause:
- (bb) a motor vehicle service, repair or towing truck, that is equipped for lifting and towing vehicles, when being engaged on the highway for the purpose of rendering service to a disabled motor vehicle or when towing a motor vehicle away from an accident or place at which it became disabled;
- (6A) Notwithstanding subsection (6), the flashing or revolving lights on a motor vehicle service, repair or towing truck referred to in clause (5)(f) may be designed to show red and amber lights in all directions.
