Explanatory Note

This Bill amends the Fisheries and Coastal Resources Act and the Wildlife Act to allow veterans of the Canadian Armed Forces to hunt in the Province and angle and fish recreationally in Provincial waters without needing to obtain a licence or pay a fee.

An Act to Amend Chapter 25
of the Acts of 1996,
the Fisheries and Coastal Resources Act,
and Chapter 504 of the Revised Statutes, 1989,
the Wildlife Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act, is amended by adding immediately after Section 79 the following Section:

    79A (1) Notwithstanding Section 79, a veteran of the Canadian Armed Forces who has been issued a Record of Service Card (NDI 75) or a Canadian Armed Forces Veteran's Service Card (NDI 75) by the Department of National Defence (Canada) may angle or fish in Provincial waters without a licence issued pursuant to the Wildlife Act or the regulations made pursuant to that Act if the veteran carries the card on the veteran's person while angling or fishing.

    (2) For greater certainty, no veteran referred to in subsection (1) is liable to pay a fee to angle or fish in Provincial waters.

    (3) For greater certainty, a veteran referred to in subsection (1) shall comply with any requirement for the tagging of fish taken.

2 Chapter 504 of the Revised Statutes, 1989, the Wildlife Act, is amended by adding immediately after Section 35 the following Section:

    35A (1) Notwithstanding Sections 26 and 35, a veteran of the Canadian Armed Forces who has been issued a Record of Service Card (NDI 75) or a Canadian Armed Forces Veteran's Service Card (NDI 75) by the Department of National Defence (Canada) may hunt in the Province or fish recreationally in Provincial waters, or pursue to hunt or fish, without a licence issued pursuant to Section 26 if the veteran carries the card on the veteran's person while hunting or fishing.

    (2) For greater certainty, no veteran referred to in subsection (1) is liable to pay a fee to hunt in the Province or fish recreationally in Provincial waters.

    (3) For greater certainty, a veteran referred to in subsection (1) shall comply with any requirement for the tagging of any wildlife or fish taken.

3 Chapter 504 is further amended by adding immediately after Section 53 the following Section:

    53A (1) Notwithstanding Section 53, a veteran of the Canadian Armed Forces who has been issued a Record of Service Card (NDI 75) or a Canadian Armed Forces Veteran's Service Card (NDI 75) by the Department of National Defence (Canada) may angle or fish recreationally in Provincial waters without a licence issued pursuant to Section 53 or the regulations if the veteran carries the card on the veteran's person while angling or fishing.

    (2) For greater certainty, no veteran referred to in subsection (1) is liable to pay a fee to angle or fish recreationally in Provincial waters.

    (3) For greater certainty, a veteran referred to in subsection (1) shall comply with any requirement for the tagging of fish taken.
