An Act Respecting Energy Efficiency
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Energy Efficiency Leader Act.
2 The purpose of this Act is to make the Province a leader in energy efficiency across the country.
(a) "benchmarking" means reporting a building's annual electricity usage;
(b) "home energy labelling" means an assessment of a home's energy performance in relation to other similar-sized homes;
(c) "Minister" means the Minister of Labour, Skills and Immigration;
(d) "municipality" means a regional municipality, town or county or district municipality;
(e) "National Building Code" means the National Building Code of Canada 2020.
4 Where there is a conflict between this Act or the regulations and any other enactment, this Act and the regulations prevail.
5 (1) The Minister shall adopt the National Building Code on or before December 1, 2023.
(2) The Minister shall authorize a municipality to adopt the energy performance tiers respecting higher levels of energy efficiency in housing and small buildings in the National Building Code.
6 (1) The Minister shall make regulations requiring
(a) home energy labelling for all residential properties that are listed for sale;
(b) benchmarking for all buildings larger than 50,000 square feet.
(2) The exercise by the Minister of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.
7 Subject to Section 8, the Minister shall deliver at least $25,000,000 in commercial retrofit projects to the Canada Infrastructure bank.
8 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
