Explanatory Note
(a) requires the Chief Medical Examiner to recommend to the Minister of Justice that a fatality inquiry be held where a death occurs under certain circumstances at a health-care facility and the Chief Medical Examiner determines that it is in the public interest for an inquiry to be held; and
(b) requires the Minister to order that a fatality inquiry be held where any death occurs at a health-care facility and the Minister determines that an inquiry into the death is in the public interest or the interest of public safety.
An Act to Amend Chapter 31
of the Acts of 2001,
the Fatality Investigations Act
1 Section 26 of Chapter 31 of the Acts of 2001, the Fatality Investigations Act, is amended by adding immediately after subsection (1) the following subsection:
- (1A) Where a death occurs under a circumstance referred to in Section 10 and the Chief Medical Examiner determines that it is in the public interest for a fatality inquiry to be held regarding the death, the Chief Medical Examiner shall recommend to the Minister that an inquiry be held.
- (2A) Where a person dies under any circumstance and for any reason while in a health-care facility and the Minister determines that a fatality inquiry is in the public interest or the interest of public safety, the Minister shall order that an inquiry be held.
