Explanatory Note

This Bill expands the application of the Act to include green hydrogen production facilities.

An Act to Amend Chapter 18
of the Acts of 2016,
the Construction Projects Labour Relations Act,
Respecting Green Hydrogen Production Facilities

Be it enacted by the Governor and Assembly as follows:

1 Paragraph 2(i)(i)(A) of Chapter 18 of the Acts of 2016, the Construction Projects Labour Relations Act, is repealed and the following paragraph substituted:

    (A) involves the on-site construction of

      (I) a natural gas liquefaction plant in Guysborough County or Richmond County, or

      (II) a green hydrogen production facility in the Province, which may include associated onshore and offshore wind power facilities,

    and which, subject to the regulations, may include the construction of any related infrastructure,

2 Section 18 of Chapter 18 is repealed and the following Section substituted:

    18 Nothing in this Act precludes

    (a) a contractor or subcontractor in the construction industry who employs non-unionized employees from performing any aspect of a designated construction project; or

    (b) the performance of any construction work on a designated construction project, for which a project agreement is in effect, by a construction subcontractor who employs non-unionized employees.
