Explanatory Note

This Bill provides that preventative and early detection lung cancer screening is an insured medical service for certain individuals who are at a high risk of developing lung cancer.

An Act to Amend Chapter 197
of the Revised Statutes, 1989,
the Health Services and Insurance Act,
Respecting Lung Cancer Screening

Be it enacted by the Governor and Assembly as follows:

1 Chapter 197 of the Revised Statutes, 1989, the Health Services and Insurance Act, is amended by adding immediately after Section 3 the following Section:

    4 (1) In this Section, "lung cancer screening" means screening for the prevention or early detection of lung cancer using a low-dose computed tomography scan.

    (2) Subject to subsection (3), lung cancer screening is an insured professional service when it is provided to a resident between fifty and seventy-four years old who regularly smokes, or in the past has regularly smoked, cigarettes.

    (3) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
