Explanatory Notes

Clause 1 amends the title of the Act.

Clause 2 amends the short title of the Act.

Clause 3 repeals definitions of Board, Chair, Vice-Chair and member, updates the definitions of Department and Minister and amends the definition of Fund.

Clause 4 repeals the provisions respecting the Invest Nova Scotia Board.

Clauses 5 and 6 change the name of the Fund.

Clause 7 removes the requirement for an annual report by the Board (which will no longer exist) to the Minister.

Clauses 8 to 10 replace references to the Board with references to the Department of Economic Development.

Clause 11 makes consequential amendments to the Accountability in Economic Development Assistance Act.

An Act to Amend Chapter 9
of the Acts of 2014,
the Invest Nova Scotia Board Act

Be it enacted by the Governor and Assembly as follows:

1 The title of Chapter 9 of the Acts of 2014, the Invest Nova Scotia Board Act, is amended by striking out "Invest Nova Scotia Board" in the second line and substituting "Community Economic Development Fund".

2 Section 1 of Chapter 9 is amended by striking out "Invest Nova Scotia Board" and substituting "Community Economic Development Fund".

3 Section 2 of Chapter 9 is amended by

(a) striking out clauses (a) and (b);

(b) striking out "and Rural Development and Tourism" in the first and second lines of clause (c) and substituting "Development";

(c) striking out "Invest Nova Scotia" in clause (e) and substituting "Community Economic Development";

(d) striking out clause (f);

(e) striking out "and Rural Development and Tourism" in the first and second lines of clause (g) and substituting "Development";

(f) striking out the semicolon at the end of clause (h) and substituting a period; and

(g) striking out clause (i).

4 The heading preceding Section 4 and Sections 4 to 21 of Chapter 9 are repealed.

5 The heading preceding Section 22 of Chapter 9 is amended by striking out "INVEST NOVA SCOTIA" and substituting "COMMUNITY ECONOMIC DEVELOPMENT".

6 Subsection 22(1) of Chapter 9 is amended by striking out "Invest Nova Scotia" in the first and second lines and substituting "Community Economic Development".

7 Section 24 of Chapter 9 is repealed.

8 Section 25 of Chapter 9 is amended by striking out "Board or, where provided by the regulations, the Chair," in the first line and substituting "Department".

9 Section 26 of Chapter 9 is amended by striking out "Board" in the first line and substituting "Department".

10 Subsection 30(1) of Chapter 9 is amended by

(a) striking out clauses (b), (e) and (f);

(b) striking out "Board" in the second line of clause (g) and substituting "Department";

(c) striking out "Board" in the second line of clause (h) and substituting "Department"; and

(d) striking out "Board" in the first line of clause (i) and substituting "Department".

11 Section 2 of Chapter 33 of the Acts of 2013, the Accountability in Economic Development Assistance Act, as amended by Chapter 9 of the Acts of 2014, is further amended by

(a) adding immediately after clause (a) the following clause:

    (aa) "Community Economic Development Fund" means the Community Economic Development Fund established by the Community Economic Development Fund Act;

(b) striking out "Invest Nova Scotia" in the second line of clause (c) and substituting "Community Economic Development"; and

(c) striking out clause (ca).
