Explanatory Note

This Bill provides that a state of emergency may only be renewed with the unanimous consent of the House of Assembly or by an Act of the Legislature.

An Act to Amend Chapter 8
of the Acts of 1990,
the Emergency Management Act,
Respecting a State of Emergency

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 19(1) of Chapter 8 of the Acts of 1990, the Emergency Management Act, is amended by adding "in accordance with this Section" immediately after "renewed" in the second and third lines.

(2) Subsection 19(2) of Chapter 8 is repealed and the following subsection substituted:

    (2) A state of emergency may only be renewed by

    (a) the unanimous approval of the House of Assembly; or

    (b) an Act of the Legislature.

    (2A) Nothing in subsection (2) prevents the Minister from declaring a new state of emergency if the new emergency is substantially different from the previously declared emergency.
