An Act to Repeal or Amend Various Statutes
Respecting Labour Relations

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 2014, the Essential Health and Community Services Act, is repealed.

2 Chapter 2 of the Acts of 2014, the Essential Home-support Services (2014) Act, is repealed.

3 Chapter 34 of the Acts of 2015, the Public Services Sustainability (2015) Act, is repealed.

4 Chapter 1 of the Acts of 2017, the Teachers’ Professional Agreement and Classroom Improvements (2017) Act, is repealed.

5 The Teachers’ Professional Agreement, as amended by Schedule A of Chapter 1, is further amended to reverse the changes made by Chapter 1.

6 Subsection 38(3) of Chapter 475 of the Revised Statutes, 1989, the Trade Union Act, as enacted by Chapter 71 of the Acts of 2011 and amended by Chapter 43 of the Acts of 2013, is further amended by adding “, after the expiry of ninety days and before the expiry of one hundred and twenty days from the day of the appointment,” immediately after “may” in the ninth line.

7 (1) Subsection 40A(1) of Chapter 475, as enacted by Chapter 71 of the Acts of 2011 and amended by Chapter 43 of the Acts of 2013, is further amended by

(a) adding “, or one hundred and twenty days have expired since the appointment” immediately after “38” in the third line of clause (b);

(b) adding clause 40A(1)(c), as that clause was enacted by Chapter 71 of the Acts of 2011, immediately after clause (b); and

(c) striking out “direct the settlement of the provisions of a first collective agreement between parties by arbitration” in the third last and second last lines and substituting “settle the provisions of a first collective agreement between the parties”.

(2) Subsections 40A(5) to (7B) are repealed.

(3) Section 40A, as enacted by Chapter 71 of the Acts of 2011 and amended by Chapter 43 of the Acts of 2013, is further amended by adding subsections 40A(5) to (7), as those subsections were enacted by Chapter 71 of the Acts of 2011, immediately after subsection (4).

(4) Subsection 40A(8) of Chapter 475, as enacted by Chapter 71 of the Acts of 2011 and amended by Chapter 43 of the Acts of 2013, is further amended by striking out “notice is served on the Board under subsection (2) or a direction is given under subsection (5)” in the first and second lines and substituting “an application under subsection (1) is made”.

(5) Subsection 40A(13) of Chapter 475 is repealed.

8 Section 40B of Chapter 475 is repealed.

9 Section 93 of Chapter 475, as amend by Chapter 35 of the Acts of 1994, Chapter 61 of the Acts of 2005, Chapter 71 of the Acts of 2011 and amended by Chapter 43 of the Acts of 2013, is further amended by striking out “, 40B” in the second line.

10 Chapter 11 of the Acts of 2015, the Universities Accountability and Sustainability Act, is repealed.

11 Chapter 13 of the Acts of 1994, the Universities Assistance Act, is re-enacted.
