An Act to Establish a Tax Credit
for Clean Hydrogen Energy

WHEREAS Canada will create regional hydrogen hubs domestically to take advantage of different regional strengths for hydrogen production and utilization opportunities;

AND WHEREAS by 2050 clean hydrogen will deliver up to 30% of Canada's energy;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Clean Hydrogen Tax Credit Act.

2 The purpose of this Act is to establish a tax credit for the production of clean hydrogen using electricity produced from renewable energy resources.

3 In this Act, "clean hydrogen" means hydrogen produced using an electrolyzer for which the electricity used is produced from qualified renewable energy resources, or by any other process that has been determined to have a rate of carbon dioxide emissions per kilogram of hydrogen produced equal to or lower than such rate for such production using other specified processes.

4 (1) The Minister of Natural Resources and Renewables shall, by April 1, 2023, develop and implement a tax credit to encourage the production and utilization of clean hydrogen.

(2) In developing the tax credit under subsection (1), the Minister shall consider

(a) how to best position the Province as an integral part of a regional hub for manufacturing and exporting clean hydrogen while adding value and jobs;

(b) how to generate economic development by capitalizing on the Province's competitive and regional advantages, including access to tidal energy;

(c) the utility of clean hydrogen in reducing the Province's greenhouse gas emissions;

(d) how clean hydrogen can cost-effectively support the Province's evolving energy system and build redundancies through electricity storage and clean fuel supply;

(e) the promotion of innovation and investment by enabling opportunities for clean hydrogen use; and

(f) strengthening collaboration by working with the private sector, the federal government, municipalities, Mi'kmaw communities, academic institutions and other stakeholders to grow and sustain a low-carbon economy in the Province.
