Explanatory Notes
Clause 1 authorizes the Governor in Council to waive taxes, tolls or fees payable by motor carriers, in whole or in part, retroactive to March 22, 2020.
Clause 2 authorizes regulations made by the Governor in Council to adopt by reference a federal statute or regulation.
An Act to Amend Chapter 292
of the Revised Statutes, 1989,
the Motor Carrier Act
1 Chapter 292 of the Revised Statutes, 1989, the Motor Carrier Act, is amended by adding immediately after Section 26 the following Section:
- 26A (1) The Governor in Council may waive, to the extent the Governor in Council deems advisable, any taxes, tolls or fees prescribed under Section 26.
(2) A waiver made under subsection (1) may be retroactive in its operation to a date not earlier than March 22, 2020.
2 Section 27 of Chapter 292, as amended by Chapter 23 of the Acts of 1992, Chapter 23 of the Acts of 1994 and Chapter 45 of the Acts of 2012, is further amended by adding immediately after subsection (4) the following subsections:
- (5) The Governor in Council may make regulations adopting by reference a document or incorporating by reference, as amended from time to time, any Act of the Parliament of Canada or regulations made pursuant to such an Act or any classification, standard, procedure or other specification.
(6) The exercise by the Governor in Council of the authority contained in subsection (5) is a regulation within the meaning of the Regulations Act.
