An Act Respecting Carbon Rebates

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Carbon Rebate Act.

2 In this Act,

(a) "Green Fund" means the fund established under subsection 112O(1) of the Environment Act;

(b) "Minister" means the Minister of Environment and Climate Change;

(c) "program" means the carbon rebate program established under subsection 3(1).

3 (1) Subject to Section 4, the Minister shall establish a carbon rebate program that allows the Green Fund to be used for direct rebate payments to persons or families residing in the Province for the purpose of offsetting the impacts of rising fossil fuel costs.

(2) Under the program, half of the Green Fund revenue collected in future cap-and-trade auctions must be paid to persons or families residing in the Province through direct rebates.

(3) Direct rebate payments under the program may only be paid to persons or families whose annual income does not exceed $50,000.

(4) Direct rebate payments in 2022 must be modelled on back stop payments being made by the Government of Canada, in accordance with the Greenhouse Gas Pollution Pricing Act (Canada), to persons or families residing in Alberta, Manitoba, Ontario and Saskatchewan.

(5) Direct rebate payments must be reviewed for future years after 2022 and be based on carbon pricing negotiations with the Government of Canada.

4 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
