Explanatory Note

This Bill requires the Minister of Community Services to

(a) maintain a record respecting reports that an adult is in need of protection; and

(b) prepare and table an annual report respecting such record.

An Act to Amend Chapter 2
of the Revised Statutes, 1989,
the Adult Protection Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 2 of the Revised Statutes, 1989, the Adult Protection Act, is amended by adding immediately after Section 15 the following Section:

    15A (1) The Minister shall maintain a record of the following information:

    (a) the number of reports made under subsection 5(1) respecting an adult in need of protection;

    (b) the details respecting any person who makes a report under subsection 5(1), including the person's relationship, if any, with the adult in need of protection; and

    (c) the action taken by the Minister or any other person or entity in response to a report made under subsection 5(1).

    (2) The Minister shall prepare, or cause to be prepared, an annual report respecting the record maintained under subsection (1) without disclosing any personal information within the meaning of the Freedom of Information and Protection of Privacy Act.

    (3) The Minister shall table the annual report referred to in subsection (2) in the House of Assembly on or before April 30th of the year in which it was completed or, where the House is not then sitting, file it with the Clerk of the House.
