Explanatory Note
This Bill expands the types of cancer presumed to be work-related for firefighters.
An Act to Amend Chapter 10
of the Acts of 1994-95,
the Workers' Compensation Act
1 (1) Subsection 35A(2) of Chapter 10 of the Acts of 1994-95, the Workers' Compensation Act, as enacted by Chapter 40 of the Acts of 2019, is amended by adding "or prescribed in subsection (3A)" immediately after "regulation" in the third line.
(2) Clause 35A(3)(b) of Chapter 10 of the Acts of 1994-95, the Workers' Compensation Act, as enacted by Chapter 40 of the Acts of 2019, is amended by adding "or prescribed in subsection (3A)" immediately after "regulation" in the last line.
(3) Section 35A of Chapter 10, as enacted by Chapter 40 of the Acts of 2019, is further amended by adding immediately after subsection (3) the following subsection:
- (3A) The following cancers or other diseases and minimum periods are prescribed for the purpose of subsection (2) and clause (3)(b):
(a) primary-site esophogeal cancer -- 25 years;
(b) primary-site lung cancer -- 15 years;
(c) primary-site testicular cancer -- 10 years;
(d) primary-site ureter cancer -- 15 years;
(e) primary-site breast cancer -- 10 years;
(f) primary-site myeloma -- 15 years;
(g) primary-site prostate cancer -- 15 years;
(h) primary-site skin cancer -- 15 years;
(i) primary-site ovarian cancer -- 10 years;
