Explanatory Note
This Bill amends the Classification of Drivers' Licenses Regulations and the Driver Training Schools Regulations to
(a) create a new Class 4 Restricted License that is required to use a personal vehicle to transport persons for hire (ridesharing); and
(b) establish experience, insurance, criminal record check and training requirements for the license.
An Act Respecting Ridesharing
1 Section 1 of the Classification of Drivers' Licenses Regulations, N.S. Reg. 174/82, made under subsection 66(1) of the Motor Vehicle Act, as amended by N.S. Reg. 232/82, is further amended by
(a) adding immediately after the provisions relating to Class 4 licenses the following provisions:
- Class 4 Restricted
(a) all types of vehicles in Classes 5 and 8;
(b) a vehicle for the purpose of transporting persons for hire.
Does not permit the operation of
(a) vehicles with air brakes or motorcycle and motor-driven cycles without an appropriate endorsement(s);
(b) type 1, 2, 3 or 4 vehicles (except as a Learner).
Age 18, 3 year's experience with at least Class 5 license, a criminal record check that shows no convictions or outstanding charges awaiting disposition under a federal or Provincial enactment on application and every two years thereafter and the completion of a Class 4 Restricted training program.
- (i) striking out the period at the end of clause (b) and substituting a semicolon; and
(ii) adding immediately after clause (b) the following clause:
- (c) a vehicle for the purpose of transporting persons for hire.
- (ba) an applicant for a Class 4 Restricted License shall meet the conditions established for a Class 5, 6, 7 or 8 license and must also provide proof of insurance that specifically provides coverage while the vehicle is being used for the purpose of transporting persons for hire.
- 8A The Department may approve a Class 4 Restricted training program that addresses the following topics:
