Explanatory Note
(a) provides that in the event of an inconsistency between the Act and a collective agreement, the greater benefit to employees prevails;
(b) requires employers to give written notice to employees when closing an industry employing 50 or more employees;
(c) requires those employers to continue to employ their employees for a period of three months after the notice; and
(d) raises the penalty for an employer closing an industry in contravention of the Act from $100 per day to $100,000 per day.
An Act to Amend Chapter 226
of the Revised Statutes, 1989,
the Industry Closing Act
Be it enacted by the Governor and Assembly as follows:
1 Chapter 226 of the Revised Statutes, 1989, the Industry Closing Act, is amended by adding immediately after Section 2 the following Section:
- 2A In the case of any inconsistency between a provision of this Act and a term of a collective agreement, the provision or term providing for the greater benefit to employees prevails.
2 (1) Subsection 3(1) of Chapter 226 is amended by
(a) adding "written" immediately after "give" in the fifth line; and
(b) adding "and employees, either personally or by registered mail" immediately after "Minister" in the last line.
(2) Section 3 of Chapter 226 is further amended by adding immediately after subsection (3) the following subsection:
- (4) Notwithstanding the Labour Standards Code, where a notice has been given under subsection (1), the employer shall continue to employ all employees subject to the notice for a period of at least three months on such terms as they were employed immediately before the notice.
3 Section 6 of Chapter 226 is amended by adding "thousand" immediately after "hundred" in the third line.
