Explanatory Note

This Bill prohibits the reduction of assistance on the basis of an applicant being enrolled in a prescribed post-secondary education program.

An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support and Income Assistance Act,
Respecting Post-secondary Education Programs

Be it enacted by the Governor and Assembly as follows:

1 Section 7 of Chapter 27 of the Acts of 2000, the Employment Support and Income Assistance Act, is amended by adding immediately after subsection (2) the following subsection:

    (3) A determination under subclause 7(2)(b)(i) or (ii) and a review under subclause 7(2)(b)(vi) must not reduce the assistance to which an applicant would otherwise be eligible on the basis that the applicant is enrolled in a prescribed post-secondary education program.

2 Subsection 21(1) of Chapter 27 is amended by adding immediately after clause (l) the following clause:

    (la) prescribing post-secondary education programs or classes of post-secondary education programs for the purpose of subsection 7(3);

3 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
