Explanatory Notes
Clause 1 repeals a provision of An Act to incorporate the Pine Grove Cemetery Company, Lower Stewiacke, Colchester County that allowed a majority of lot holders to assess themselves for money for the cemetery to a maximum of one dollar per year and allowed the cemetery to sue for recovery of that money.
Clause 2 prohibits any person, other than a trustee, from fencing or improving a lot, erecting a monument or setting out trees or plants in the cemetery.
Clause 3 removes specific penalties from the Act for the destruction, damage or theft of monuments and cemetery property.
Clause 4 removes a restriction on persons in arrears for dues to the corporation from voting at meetings of the cemetery corporation.
Clause 5 repeals a provision that purported to give the trustees the power to remove graves for the laying out of lots, avenues and paths.
An Act to Amend Chapter 211
of the Acts of 1904,
An Act to incorporate
the Pine Grove Cemetery Company,
Lower Stewiacke, Colchester County
Be it enacted by the Governor and Assembly as follows:
1 Section 10 of Chapter 211 of the Acts of 1904, An Act to incorporate the Pine Grove Cemetery Company, Lower Stewiacke, Colchester County, is repealed.
2 Section 14 of Chapter 211 is repealed and the following Section substituted:
- 14 No person, other than the trustees, may fence or improve a lot, erect a monument or set out trees or plants in the cemetery.
3 Section 15 of Chapter 211 is amended by striking out "by a fine not less than four dollars nor more than forty dollars, or be committed to the common jail for the space of not more than sixty days," in the sixth to eighth lines.
4 Section 19 of Chapter 211 is amended by striking out ", except when in arrears for dues to the corporation" in the third and fourth lines.
5 Section 22 of Chapter 211 is repealed.
