Explanatory Notes
Clause 1 clarifies that the definition of "lobbying" in the Lobbyists' Registration Act includes oral and arranged communication.
Clauses 2 to 4 require consultant lobbyists, in-house lobbyists and organizations using in-house lobbyists to disclose the names of every public-office holder they have lobbied, the dates and means by which lobbying occurred and the nature of issues discussed with the public-office holder.
Clause 5 requires a public-office holder to verify lobbyist returns that involve the public-office holder.
An Act to Amend Chapter 34
of the Acts of 2001,
the Lobbyists' Registration Act
1 Clause 2(1)(c) of Chapter 34 of the Acts of 2001, the Lobbyists' Registration Act, as amended by Chapter 57 of the Acts of 2010, is further amended by adding "including oral and arranged communication," immediately after "communication," in the second line.
2 Subsection 5(4) of Chapter 34, as amended by Chapters 33 and 57 of the Acts of 2010, is further amended by adding immediately after clause (m) the following clause:
- (ma) the names of every public-office holder the consultant lobbyist has lobbied, the dates and the means by which lobbying of the public-office holder occurred and the nature of issues discussed with the public-office holder;
- (na) the names of every public-office holder the in-house lobbyist has lobbied, the dates and the means by which lobbying of the public-office holder occurred and the nature of issues discussed with the public-office holder;
- (na) the names of every public-office holder a lobbyist for the organization has lobbied, the dates and the means by which lobbying of the public-office holder occurred and the nature of issues discussed with the public-office holder;
- 12A Where a public-office holder is identified in any return, the public-office holder shall verify for the Registrar any information in the return that relates to the public-office holder or of which the public-office holder has knowledge.
