Explanatory Note

This Bill requires the Minister of Health and Wellness to ensure safe nurse staffing levels in Nova Scotia hospitals.

An Act to Amend Chapter 208
of the Revised Statutes, 1989,
the Hospitals Act

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Protection of Patient Safety Act.

2 Chapter 208 of the Revised Statutes, 1989, the Hospitals Act, is amended by adding immediately after Section 12 the following Section:

13 (1) The Minister shall ensure processes are in place that allow minimum nurse-to-patient ratios to be adjusted based on feedback from front-line nurses respecting changes in acuity, complexity and other factors affecting patient care.

(2) The Minister shall collect and report on, in a manner accessible to the public, data respecting adverse patient events.

(3) To ensure transparency and accountability, the Minister shall make publicly available data respecting nursing care, including staffing levels and staff mix.

3 Chapter 208 is further amended by adding immediately after Section 17 the following Section:

17A (1) The Minister shall make regulations establishing evidence-based, minimum nurse-to-patient ratios on a unit-by-unit basis for all hospitals.

(2) The regulations may establish different ratios for acute care, acute psychiatric and other specialty hospitals or hospital wards.

4 Section 18 of Chapter 208 is amended by striking out "Section 17" in the second line and substituting "Sections 17 and 17A".
