Explanatory Notes
Clause 1 sets out the short title of the Act.
Clause 2 establishes a deadline for receipt of applications by the Workers' Compensation Board of Nova Scotia from dependent spouses who are applying to have their survivor benefits reinstated to April 17, 1985.
Clause 3 permits survivor benefits that were discontinued on remarriage to be reinstated to a dependent spouse, to April 17, 1985.
An Act to Amend Chapter 10
of the Acts of 1994-95,
the Workers' Compensation Act,
to Extend Pension Entitlement
to More Workers' Widows
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Widows' Pension Act.
2 Section 60A of Chapter 10, as enacted by Chapter 1 of the Acts of 1999 and amended by Chapter 5 of the Acts of 2002, is further amended by adding the following subsections immediately after subsection 60A(3):
- (3A) An application pursuant to subsection (3) by a dependent spouse whose survivor benefits under the former Act were discontinued on remarriage before April 17, 1985, must be made on or before June 1, 2014.
(3B) The Board may extend the deadline referred to in subsection (3A), before or after it expires, if it appears to the Board that there are reasonable grounds for the extension.
3 Clause 60A(6)(a) of Chapter 10 of the Acts of 1994-95, as enacted by Chapter 1 of the Acts of 1999, is amended by striking out "January 1, 1999" in the first line and substituting "April 17, 1985".
