Explanatory Note

This Bill permits renewable-energy providers to sell directly to customers.

An Act to Amend Chapter 25
of the Acts of 2004,
the Electricity Act,
Respecting Renewable Energy Providers

Be it enacted by the Governor and Assembly as follows:

1 Chapter 25 of the Acts of 2004, the Electricity Act, is amended by renumbering Section 4A as Section 4AA and adding immediately preceding that Section the following Section:

4A Notwithstanding any enactment, a renewable-energy producer may sell electricity directly to a customer.

2 Subsection 5(1) of Chapter 25, as amended by Chapter 14 of the Acts of 2010 and Chapter 15 of the Acts of 2011, is further amended by relettering clause (da) as clause (daa) adding immediately preceding that clause the following clause:

(da) respecting renewable energy producers' authority to sell directly to customers;
