Explanatory Note
This Bill amends the Nova Scotia Provincial Exhibition Commission Act to increase the size of the Board of Directors to ten, three of whom will be appointed or elected annually and seven of whom will be elected to serve the terms set by the Act or by the Commission by by-law.
An Act to Amend Chapter 69
of the Acts of 1992,
the Nova Scotia Provincial
Exhibition Commission Act
Be it enacted by the Governor and Assembly as follows:
1 Subsections 7(2A) and (2B) of Chapter 69 of the Acts of 1992, the Nova Scotia Provincial Exhibition Commission Act, are repealed and the following subsections substituted:
(a) one director appointed annually by the Town of Truro or elected pursuant to subsection (2C);
(b) one director appointed annually by the Municipality of the County of Colchester or elected pursuant to subsection (2C);
(c) one director appointed annually by the Village Commissioners of Bible Hill or elected pursuant to subsection (2C);
(d) two directors elected at the annual meeting in 2012, or their successors, to hold office for three years or the term set by by-law;
(e) two directors elected at the annual meeting in 2013, or their successors; and
(f) three directors elected at the annual meeting in 2014, or their successors.
(2B) The directors who hold office at the time this subsection comes into force continue to hold office until their terms of office expire.
(2C) Where the Town of Truro, Municipality of the County of Colchester or the Village Commissioners of Bible Hill fail to or decline the opportunity to appoint a director before the annual meeting in any year, or decline the opportunity to make subsequent appointments, a director must be elected at the annual meeting to fill that office until the date of the next annual meeting.
(2D) The terms of office of the directors elected pursuant to clauses (2A)(e) and (f) must be set by the Commission by by-law.
2 Subsection 9(1) of Chapter 69 is amended by adding immediately after clause (c) the following clause:
