Explanatory Note

This Bill provides that the portion of any rate increase granted for Nova Scotia Power Incorporated that is attributable to an enactment of the Province or a policy, decision or other requirement of the Government does not take effect until specifically approved by an Act of the Legislature.

An Act to Amend Chapter 380
of the Revised Statutes, 1989,
the Public Utilities Act,
Respecting Transparency
in Power Rates

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Transparency in Power Rates Act.

2 Chapter 380 of the Revised Statutes, 1989, the Public Utilities Act, is amended by adding immediately after Section 64A the following Section:

64B (1) In making an application to the Board for a change in rates, Nova Scotia Power Incorporated shall identify any portion of a requested rate increase attributable to an enactment of the Province or to a policy, decision or other requirement of the Government of the Province.

(2) The Board shall review the portion of the requested rate increase identified pursuant to subsection (1) and confirm or revise it as the Board considers necessary to implement the enactment or requirement identified.

(3) Where the Board grants a rate increase that includes a portion that is confirmed or varied pursuant to subsection (2), that portion of the rate increase is of no effect until that portion and the basis for it are specifically approved by an Act of the Legislature.
