Explanatory Note

This Bill permits the Chief Electoral Officer, on the advice of the Election Commission, to make regulations to allow for electronic and internet voting.

An Act to Amend Chapter 140
of the Revised Statutes, 1989,
the Elections Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 140 of the Revised Statutes, 1989, the Elections Act, is amended by adding immediately after Section 106A the following heading and Section:

ELECTRONIC VOTING

106B (1) The Chief Electoral Officer may, on the advice of the Election Commission, make such regulations as the Chief Electoral Officer considers necessary or advisable to permit electronic and internet voting.

(2) The exercise by the Chief Electoral Officer of the authority contained in subsection (1) is regulations within the meaning of the Regulations Act.
