An Act to Enable
the Village of Canning to Transfer
Certain Lands to the Canning Library
and Heritage Centre Association

WHEREAS The Village Commissioners of Canning acquired lands located at 9806 Main Street, Canning, Kings County, Nova Scotia, in 1993 for the benefit of an unincorporated association of persons that intended to establish and operate a library and heritage centre;

AND WHEREAS it was the intention of the parties involved in the acquisition of the lands that, after the unincorporated association raised the funds required for the establishment of the library and heritage centre and established a body corporate for the purpose of operating the library and heritage centre, The Village Commissioners of Canning would transfer title to the lands to that body corporate;

AND WHEREAS the Canning Library and Heritage Centre Association was incorporated on May 30, 1996, pursuant to the Societies Act;

AND WHEREAS Section 404 of the Municipal Government Act continued The Village Commissioners of Canning under the name "Village of Canning";

AND WHEREAS the effect of Section 446 of the Municipal Government Act would prevent the Village of Canning from transferring the lands to the Canning Library and Heritage Association unless the Association paid the market value of the lands, notwithstanding that the members of the Association had previously raised funds for the acquisition of the lands;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Canning Library and Heritage Centre Exemption Act.

2 In this Act, "Library and Heritage Centre lands" means the lands located at civic address 9806 Main Street in Canning acquired by The Village Commissioners of Canning from Irving Oil Company, Limited and Irving Oil Limited by deed dated October 4th, 1993, which deed was recorded on October 12th, 1993, in the Kings County Registry of Deeds in Book 956 at Page 506 as Document Number 7732.

3 Section 446 of the Municipal Government Act does not apply to a conveyance of the Library and Heritage Centre lands by the Village of Canning to the Canning Library and Heritage Centre Association.
