Explanatory Note

This Bill amends the Workers' Compensation Act to authorize the Minister of Labour and Workforce Development to exempt the workers in a fishing business from the Act if the workers are covered by private disability insurance.

An Act to Amend Chapter 10
of the Acts of 1994-95,
the Workers' Compensation Act

Be it enacted by the Governor and Assembly as follows: 1 Chapter 10 of the Acts of 1994-95, the Workers' Compensation Act, is amended by adding immediately after Section 3 the following Section:

3A (1) In this Section, "fishing business" means an employer engaged in fishing and includes an individual, a partnership or a corporation.

(2) Where the workers in a fishing business are covered by private disability insurance, the Minister may, notwithstanding Section 3, any regulation made pursuant to that Section or any other enactment and upon application by the fishing business in the form prescribed by the Minister, exempt those workers from the application of this Part subject to such terms and conditions as the Minister may determine.
