An Act Respecting the Appointment
and Duties of a Commissioner to Ensure
the Fair Access to Regulated Professions
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Access to Regulated Professions Act.
2 The purpose of this Act is to appoint a Commissioner to help ensure that regulated professions and individuals applying for registration by regulated professions are governed by registration practices that are transparent, objective, impartial and fair.
(a) "Commissioner" means the Commissioner on Fair Access to Regulated Professions appointed pursuant to this Act;
(b) "Committee" means the Committee of the House of Assembly designated by the House.
4 (1) The Committee shall appoint a Commissioner on Fair Access to Regulated Professions.
(2) The Commissioner holds office for a term of five years and may be re-appointed.
(3) Subject to Section 8, the Governor in Council may establish the remuneration and other terms of employment of the Commissioner.
(4) The Commissioner is an employee within the meaning of the Public Services Superannuation Act.
5 The Commissioner is a public officer reporting to the House of Assembly.
6 The Commissioner shall assess the registration practices of regulated professions and advise the House of Assembly in an independent manner on the need for legislation, policies and practices to ensure the transparent, objective, impartial and fair processing of all applicants for registration by a regulated profession.
7 (1) The Governor in Council may make regulations respecting any matter necessary or advisable to carry out effectively the intent and purpose of this Act
(2) The exercise by the Governor in Council of the authority contained in subsection (1) is regulations within the meaning of the Regulations Act.
8 The monies required for the purpose of this Act shall be paid out of moneys appropriated for that purpose by the Legislature.
