Explanatory Note

This Bill provides that a home study respecting prospective intercountry adoptive parents is valid until the adoption has taken place but that after two years the home study must be reviewed annually.

An Act to Amend Chapter 15
of the Acts of 1998,
the Intercountry Adoption Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 15 of the Acts of 1998, the Intercountry Adoption Act, is amended by adding immediately after Section 9 the following Section:

9A A determination made for the purpose of Article 5 or Article 17, sub-paragraph d, of the Convention that prospective adoptive parents are eligible and suited to adopt

(a) is valid until the adoption in respect of which it was made has taken place; and

(b) two years after being made, must be reviewed annually.
