Explanatory Note

This Bill amends the Environment Act to provide that, notwithstanding any enactment, no levy, tax, fee or additional charge may be placed on the sale of any item that can later be recycled for fuel purposes.

An Act to Amend Chapter 1
of the Acts of 1994-95,
the Environment Act, to Prohibit Levies, Taxes,
Fees or Additional Charges on Recyclable Items

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 1994-95, the Environment Act, is amended by adding immediately after Section 96 the following Section:

96A (1) Subject to subsection (2), notwithstanding any enactment, no levy, tax, fee or additional charge may be placed on the sale of any item that can later be recycled for fuel purposes.

(2) The moneys required for the purpose of subsection (1) shall be paid out of moneys appropriated for that purpose by the Legislature.
