Explanatory Note

This Bill amends the Education Act to require the Minister of Education, in consultation with the Minister of Transportation and Public Works, to ensure development of a plan containing a proposed schedule for the construction of sidewalks in all school areas and to table the plan in the House of Assembly before January 1, 2008.

Requiring Sidewalks in School Areas

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 1995-96, the Education Act, is amended by adding immediately after Section 145, the following Section:

145A (1) Subject to subsection (4), the Minister, in consultation with the Minister of Transportation and Public Works, shall ensure that a plan is developed to construct sidewalks in all areas designated as school areas pursuant to the Motor Vehicle Act.

(2) The plan referred to in subsection (1) must include a proposed schedule for the construction of the sidewalks.

(3) The Minister shall, before January 1, 2008, table the report referred to in subsection (1) in the House of Assembly if the House is sitting or, if the House is not then sitting, file the report with the Chief Clerk of the House.

(4) The moneys required for the purpose of this Section shall be paid out of moneys appropriated for that purpose by the Legislature.
